Hi everyone,

I have twins who are 8 years old. I got acceptance offer from school to study in Canada, and we have decided that I go to Canada with our kids and my husband stays back home to provide financial support for us. We also have had the letter from the school that I stay with my kids as their responsible biological parent.

I got rejected today and the reason mentioned is that I am not returning to my home country.

Here are my questions:

1) Since I decided to stay with my kids, I did not fill out the custodianship form. Should I still do that ? (I need to mention that in the rejection letter, there is nothing mentioned related to this form)

2) I am afraid if I submit custodianship, they might issue my kids study permit, while they reject my visitor visa. I cannot leave my 8 year olds to go to Canada alone. And in this case there will be no return from school for the tuition fee.

I dont think the issue is with custody. The main problem is that you have to show strong family and economic ties to your home country. Your 2 twins are your strong ties and they will be accompanying you. Even if your husband remains in the home country, he will join you any time in Canada and then you have no reason to return. so, now you have to convince the visa officer about your intentions to return.

It's got nothing to do with custody of your kids. You got rejected, not your kids.

You need to convince them that you will return to your home country before they'll give you the study permit

The VO is probably thinking, OK student coming to Canada to study, fine. Bringing her twins, but leaving husband behind. Why is the applicant not leaving her kids back in her country, versus bringing them with her ? Would it not be easier for her to complete her studies if her children are not left back in her country ?
Why are you bringing your kids ?
If you got approved with your children to come to Canada, then your husband could drop everything and move to Canada, and there yah go, no more ties at all to your country, you are all here in Canada

Why is the applicant not leaving her kids back in her country, versus bringing them with her ? Would it not be easier for her to complete her studies if her children are not left back in her country ?

If you are not willing to let your children go to Canada without you, then I wouldn't bother reapplying.

There is no visa that allows you to accompany your children on a study permit to Canada and live with them here while they study. The most you can apply for is a TRV. However a TRV only allows you to come here temporarily as a tourist, not live here for the better part of a year.
 
Oh I totally misunderstood - it's the kids that got into a school to study.

Sorry, my previous post assumed it was the mom who was going to study. Ignore that post :)

Unfortunately the school's requirements will cut no ice with IRCC. There is no "long-term" visa available for parents. You cannot stay with them for longer than six months.
 
You need to contact the school district and make arrangements for a custodian in Canada who can take care of your kids while they study. You cannot live here with them .

Does it help, if I apply to one of the Canadian colleges to get acceptance letter?

I though this would make it more complicated. Since if I study in Canada, my kids education would be free. We are happy to pay for our kids education, and that's why I didn't apply for the study permit initially

When minor children come to Canada on a study permit, you must appoint a custodian / guardian for them in Canada who will take care of them while they are here. This needs to be an individual who is already living in Canada. Additionally, there are some agencies that provide this services for a fee. The custodian / guardian is needed specifically because the parents are not entitled to move to Canada with their children.

So that's the main concern we have. Our kids are too young to be separated from the family
