Need help for my friend

This is for a friend of mine here in Toronto who has arrived as a student from past four months, pursuing Strategic Management Accounting, a PG Certificate program ending December 2016. He secures a one year open work permit upon completion of this course.

Additionally, he is also planning to get married with his fiance who has already finished her two post graduate programs here, thus securing her three year work permit.

My friend has eight years of work experience in India in field of Auditing, Taxation, Accounting, Operations and Insurance which include a three year and six months internship at Chartered Accountants firm. He is a Commerce Graduate, M.B.A. (finance) from Sikkim Manipal University a distance learning program and intermediate year of Chartered Accountants. Her fiancé has also secured Bachelors in commerce and one year of experience in India.

The main question is at this point of time is
-Can he marry his fiancé (he is on a one year student visa) and become dependent, as she is holding a three year work permit. He needs to save and built up my finance and thus is in no mood to pursue a second year of relevant study to obtain a three year work permit.

-If the answer to the above question is yes, then over a period of time, can he apply for a PR under the express entry as a primary applicant? Combined, their evaluated scores are 464. (assuming CLB level 9 for both of them)


Awaiting some thoughts on this.

For sure, he can get married and become dependant. He can get a dependent work permit after his PGWP expires.

He can be a principal applicant later and apply for PR under FSW category. 464 is a good score to get an ITA by end of this year or next year.

Note that your friend's spouse must first have a NOC A, B or 0 job before he will qualify for a spousal work permit based on her PGWP.

So if my friend's spouse qualifies for NOC A,B or 0 through her previous work experience in her home country, then it is valid?

Please throw some light on this?

No, the spouse should be working in a NOC A,B or O job within Canada. The spouse's WP should also be valid for atleast 6 months at the time of application.

No, she must actually be WORKING a skilled job here in Canada and be able to provide payslips for the SOWP application.
