Need fiancee to stay in CA permanently

Hello everyone,

I'm currently attempting and somewhat struggling to gather all the information i need in order to proceed with the process of making sure that my fiancee stays in CA after her student visa expires.

Background

I'm a Canadian Citizen been here most of my life originally from Russia. My fiancee has been here since about November 2012 on a Student/Work Visa which is valid until June 1st 2013. She is also from Russia.
At the moment she's attempting to get into a school which will allow her to extend her student visa while looking for work which could potentially extend her work visa. On top of that we need more time to plan the wedding and anything else that comes up in that regard. I have a bad feeling that if we miss something here that she will end up going back to Russia and i will have to sponsor her from there. The best outcome for us is if she stays here through out the whole process.

Would someone kindly lay out the options that we have?

Easiest / guaranteed option for having her stay is forget the big wedding, get married now in Canada and then sponsor her as your spouse through the inland (within Canada) stream. Make sure you submit the sponsorship application before her study permit expires.

It will take some time for the sponsorship papers to get processed. If i submit them before her visa expires and the documents dont arrive until way after her visa expires should she just stay here and apply for extension of some sort? There is some marriage visa or something?

If you file Inland and include an open work permit application, she will have "implied status" on the work permit until she gets it. She will be able to legally stay after her student visa expires. Just make sure to include the OWP application and pay the fee for it. It usually takes 6-7 months to get the work permit. She will be fine until then.

Does anyone know if my fiancee will need her birth certificate from Russian for when ill be submitting her PR documentation package or is passport enough?

It will be in her country's instructions.

It looks like she will need to provide a birth certificate to me, although I'm not 100% sure. There's room for interpretation because it says "for all family members to prove relationship" and if she's not trying to bring children, I don't see why it would be needed. I would get it and send it just to be on the safe side regardless.

I looked through that document quickly and it does ask for country specific stuff, but if i understand this correctly this is if shes still living in Russia. At the moment shes currently living in Canada on a work/school permit. I wonder if that guide still applies to her. Since ill be filling out PR for inland.

It's listed on it's own line in the Inland document checklist. I would take this to mean, yes, you need to include it.

Thanks guys you've been very helpful so far. Im almost done putting together all the prereqs documents.

Question: In the document check list it's listed to get " Proof of medical examination (if you do not hold a valid Medical Report, instructions will be given to you when you receive your notice of eligibility)"

I do not understand, does she have to get the medical or since at the moment she doesn't have one, sometime through the application process the Governmant will ask her to go and get one. What is this notice of eligibility?

She should get the medical done now (before the application is submitted) and then submit the proof of medical examination along with the application.

Thanks Scylla - im guessing she can get her medical done in any walk in clinic and they will refer her to further place if needed?

Another question: They need her Original Police report. We're in the middle of attempting to get it from Russia and its a huge pain in the a$$. Because they wont translate it to english and when her father tried to get it on behalf of her they gave him some BS talk that she needs to be there in person. As far as i can see there is an application that needs to be handed to the police in russia and they file the police report and send to her here?

Am i understanding this correctly? Any advise?

I don't know about the handing it off in person, but I think it's your job to make the report in Russian and get it translated and certified.

No - she cannot just have it done at any walk in clinic. Follow the instructions amikety has provided. I would also recommend that you read through the Instruction Guide again in detail since some of the questions you are asking are fairly basic and you don't want to make a mistake in your application.
