Hi Friends,

My friend got his work Permit in oil industry from India. He applied through a consultant who is based in Canada. When he reached Alberta, employer told him that he don't have the job anymore due to Oil Industry recession. Employer also took my friend's written exam and told him that he failed in the test and since he could not pass; this is the reason employer can not take him and signed a paper saying he can not keep my friend as he failed the exam.

Now, my friend is having one year work permit from that Oil company. What are his options? Can he still live in the country for a year and look around work elsewhere? Or he has to leave the country as soon as possible?

Can he make any complaint about employer or consultant?

Consultant is Indian and Employer is white Canadian. Apparently Consultant charged him around $10000. What can be the best solution to come out of this situation for my friend..Any suggestion will be appreciable..

Is the company's name written on the work permit? i mean is it a closed work permit? or open to any employer?

Your friend should look at the information here,
http://work.alberta.ca/Immigration/workers.html

and contact the helpline for advice on whether a complaint about the employer and/or the employment agency can be made. They will, if necessary be able to direct him to resources to help in making any complaints.

He can stay in Canada until his work permit expires.

If he has a closed work permit, any new employer will have to apply for an LMIA for him before he can work for them.

If he has an open WP, he can work for a new employer right away.

This is one of the frustrating story. $10000 is huge. Did he talk to consultant and ask about the $10000 after losing job?Somehow I guess this is closed work permit. And is he sure everything is genuine?

I will check with him. He is on closed work permit.

The consultant is not picking up his phone now. Yes $10000 is a huge money for Work Permit. But thats how much they normally charge to offer paid job. Yes, this is a closed work permit.

Your friend is legally entitled to remain in Canada until work permit expires. He cannot take another job though, because it is a closed work permit. He will have to reapply for work permit if he gets new job. He will run into complications if he leaves and tries to re-enter Canada based on this work permit.
