Need advise for SPOUSAL VISITOR VISA(BRYANNA PLEASE LOOK INTO IT )

HI ALL,

I got married 2 months ago, my wife is on study visa in Canada since September 2016 on 2 years post grad course and her study visa is finishing on April 2018. I am going to apply for visitor visa to visit her. But I have already got three refusals for Canada study visa one last year in April rest 2 were in the year 2013. I need your help to suggest me what extra shall i do to make my application successful AS I AM WORRIED ABOUT MY PREVIOUS REFUSALS. Documents I am going to attach are following :

1. All Academic Documents
2. Work Experience Documents.(present job joining letter, experience letter, pay slips last 3 months)
3. Joint saving Account statement of me and my wife showing funds of Rs. 5.5lacs in India(Old amount - Last 6 months statement).
4. Jjoint FDR with dad of 5 lacs
5 Made WILL from my dad on my name for home and agricultural land.
6 Itinerary for the visit of 2 weeks(included Canadian tourist places and also booked the hotels in their locations)

Documents from wife:

1. Passport Copy, Visa Copy, Study Permit Copy.
2. Enrollment Letter from the college.
3. College ID Card, Offer Letter, 1st sem Transcript, last fee receipt.
4. Residential Agreement Copy or Any other document showing proof of address in Canada.
5. Phone No and Email id.


Documents to substantiate that me and my wife are in a stable relationship:




1. Marriage Registration Certificate.

2. Marriage Photographs and other casual photographs together.

3. Wedding Card, Combined CD's Roka, Sagan, Wedding.

4. Passport showing Shiny as your spouse.

5. Adhar Card(indian unique identity card) showing spouse address as your address or any other document.



P.S - I was in UK from 2007-2015 (4 years on study visa and 4 years work permit).I came back on nov 2015 to india and I am working in a small IT firm in my city from last six months with salary of 3 lac per annum


ALSO SOMEONE HAS ADVISED ME TO LET MY WIFE TO APPLY FOR MY VISITOR VISA FROM CANADA INSTEAD I APPLYING FROM INDIA BECAUSE CANADIAN VISA OFFICERS ARE LINEANT THAN INIDAN VISA OFFICIALS

PLEASE HELP ME GUYS.....

1. What were the refusal reasons? Why were you refused when you applied from the UK?

2. Since how long have you been working at your current employment?

3. Is your dad dependent on you financially? Do your siblings live with you?

4. Do you live with other family members who are dependent on you?

5. Apart from your employment, do you help your dad for the agricultural land?

6. Is the interest from the FD (joint ownership with your dad) credited to a joint bank account/your bank account? When was this FD made and was it made with your earnings?

REASONS FOR FIRST REFUSAL ON STUDY PERMIT APPLIED FROM UK ON 25/10/2013
You have not satisfied me that you would leave Canada at the end of your stay. In reaching this decision, I considered several factors, including:

3. Dad is a pensioner and he is not really dependent on me cos he has got his own savings. i have just got one younger sister

4. Do you live with other family members who are dependent on you?
4. i live with mom, dad and younger sister and I contribute little bit in family financially


5. Apart from your employment, do you help your dad for the agricultural land?
5. Agricultural land is on the name of my grandad(expired 10 years ago) and there is no income from it yet as we are trying to sell it.

6. Is the interest from the FD (joint ownership with your dad) credited to a joint bank account/your bank account? When was this FD made and was it made with your earnings?
6. Interest from FD goes to dad s personal bank account, it was made 3 months ago from dad s savings.

You married two months ago. Do you/did you have any other immediate family who lives in Canada when you applied in 2013?

Were you working in India (another employer) before you started working at this new job?

Do you file ITRs?

yes i got married 2 months ago, but got engaged on 14-08-2016 .

my first cousin resides in canada with his family from last 6 years, he was there when i applied in 2013

no i was not working at any other employer except this one because i came back to india on november 2016 and then started doing paper work and ielts to apply for canada study visa which later got refused on april 2016 . AFter that i started working at my new job

yes i have filled itr while i was in india

Hi,

IMHO, you must NOT reapply at this point of time. I think you will get another refusal.... which will only make your chances of getting another TRV/visa difficult in the future.

If your travel agent claims that you have good chances of getting a TRV then he is not sincere/he only wants your money.


This is why I think you will be refused again:
1. You have three previous refusals. Your best chance of getting a TRV was when you were in the UK as you had much stronger ties than now.

2. Your wife is in Canada.

3. You do not have any strong ties to India. Not even your employment (which is your only tie).

4. You have started working very recently + the salary you earn (especially as an IT professional, UK qualified, UK work experience) is unusually low. It will not convince the visa officer that you will return to India.

5. Your home/agricultural land which is in your grandfather's name cannot be shown as your property. The Will made by your dad will not work for this TRV application.

6. Your family is not dependent on you, either financially or otherwise.

7. The ITRs which you filed were not based on your actual income

8. The FD was made with your dad's earnings + it is in your dad's name + the interest is credited to your dad's bank account. Hence, it cannot be shown as your FD


I strongly suggest that you do NOT reapply unless your situation changes considerably i.e you get a higher paying job which is on par with the typical salary levels of IT professionals + you apply after at least 6-8 months of joining a new job + your individual financial situation improves + you are able to establish other ties

This is incorrect. Your wife cannot apply for your TRV from within Canada.

She can apply online. However, your application will be considered as Outside Canada (because of your address). It will be processed either by a India visa office, or by ANY other visa office in the IRCC global visa network

Hello Bryanna,

I have recently got Canadian Visit Visa (on 29th January 2017) valid till December 2020. My initial plan was to travel on 19th February but I have postpone this due to some of my personal and official reasons. Now I am planning to apply for rest of my family members (wife and two sons) to have a family trip in summer vacations. Some of details are as following.

1. Myself
• I am a software engineer by profession having more than 12 years of continuous working experience in different organizations on managerial and non-managerial positions.
• Total earning (Job) is almost 2.3 Million per year.
• One of my brother is Canadian Citizen.
• I hold three properties total worth of 8.4 Million.
• 1.4 Million in Bank Account (Salary account).

2. Family: wife and two Sons( 7 Year and 3 year of age).
• My wife was a school teacher before marriage but now she is house wife and a running a home tuition setup.
• She is enrolled in one year distance learning program (Montessori education).
• She hold a property on her name. this property is purchased on installments total worth of 4.2 Million and 3.1 Million is already Paid following by ongoing installments.
• One of my son is enrolled in School (Class One).

Bryanna, I request you to please guide for the following points.

a. Covering letter will be from my side elaborating the purpose and other details or my from my wife?
b. In the invitation letter, will my brother invite all the family members or excluding me.
c. Can I attach my documents (education, working Experience and assets details with the application.

You are requested to please guide in this regards and any other suggestion. May you 100% Lucky all the times.

I am applying for visitor visa online for my parents. I am writing an invitation letter. I am writing an explanation letter on my parent's behalf. Now I have a doubt whether signature is required on these letters. Should I print them, sign it, scan them back to upload into the portal?

Should I write a letter stating my parents names belong to them because initials in the front of the name in certain documents, initials at the back of the name in certain document, no surnames used....
