I am a Mexican citizen living in the US for the past 5 yrs. entered as a tourist but stayed. I have worked done taxes established credit and have two houses, my three children are US citizens, I have a college degree from Mexico and want to apply for a Canadian Visa.

Will this affect my eligibility or do I just apply as if I was living in Mexico?

In order to apply from the US you would have to have been admitted legally for at least one year. If you arrived in the US with a visa to stay for one year you may apply from there.

If you have not been legally in the US for one year (regardless of how long you stayed after) then you will have to apply through Mexico.

If you apply through Mexico you may be asked for an interview which would be scheduled to occur in the Mexican Visa Office, thus you would have to cross the border. If you are in the US illegally you may encounter problems when crossing the border for your interview.

I think you have not options other than apply in Mexico, it should be at the Canadian embassy In Mexico city, due that your status...., no matter if you have kids borned in the US. it will not help at all.

It would be a hard desition to make if you really intend to apply for canadian PR due that you have family over there, of course you will not have any issue crossing the border to Mexico, but I guess you will like to go back to the US... you can figure out what will happen. (I have some brothers in the same situation like yourself living in the US)
