No - he won't be able to stay just because you're married. You will have to sponsor him as a permanent resident. Start reading here to find out more about the spousal application process:

Hi Scylla thanks for the fast reply as far as I can see I dont think we would have any problems going through the process and my bf has a swiss passport maybe that counts for something?

The Swiss passport won't really count for much. The important part of a spousal application is proving your relationship is genuine. Getting married alone isn't sufficient proof. So start collecting other supporting information now (e.g. photos, flights, emails, call records, etc.).

Shinta -

Since you are just starting this process, I would very strongly recommend that you spend a few days reading through the messages on the Family Class section of this site: http://www.canadavisa.com/canada-immigration-discussion-board/family-class-sponsorship-b5.0/

This part of the site will provide you with information about the different options available to you (e.g. applying outland vs. inland) and provide you with the opportunity to learn from the experiences of others. Many of the questions you have are likely already answered there. You'll also get a much better sense of how long the process takes, what information you'll have to put together, what your husband will/won't be able to do while waiting for approval, etc.

Hope this helps.

livstar -

Did you submit an inland application?

If so, then there's technically nothing stopping you from leaving Canada. However if you can't get back into Canada after you trip back home - then your application will be canceled and you'll have to start again from scratch.

Unfortunately no here can tell you if you will be let back in or not. You might be let back in without any problems - or you might not. This is the risk you take by leaving the country. If you are from a visa exempt country (i.e. from a country where you do not require a visa to visit Canada) then the chances are obviously higher that you will be able to re-enter without issue. But again, no one can tell you for sure what will happen.

It still depends on whether you submitted an inland application or not. Being in Canada when you applied does not indicate which application (outland or inland) you submitted. While in Canada it is possible to submit an outland application.

If you applied outland (your visa is processed in your home country), then you can leave during processing with no consequence if you do not (or can not) return to Canada. If applied inland, then your application while be discarded if you are not able to be in Canada when the visa is ready to be issued.

Can you provide more information about the type of visa you submitted and whether or not you are visiting from a visa exempt country?
