HELLO ALL,

Here is my situation. I AM BASED IN QUBEC

Me and my partner got married on 28th Sep and are now in steps to send the spousal sponsorship application. We are currently waiting on the wedding certificate to arrive as it's mandatory to send one with the application.

My current open work permit is expiring on 9th NOV.

My plan is to apply for a work permit extension to maintain my status and then apply for an open spouse work permit when we have sent the spousal application.

My questions are-

- when I am on implied status with my work permit extension and then submit another spousal work permit application later, Can I keep working until I have my Spousal work permit processed ?
- do I need AOR to apply for SPOWP ? As I have maintained my status through other work permit?
- Even after AOR I submit my application for SOWP, can I keep working even after my first work permit application is rejected?
- if there are any other better ways I can handle this, please do comment.

if it can come and therefore you can submit your PR application BEFORE your current work permit expire, you should wait for it and apply for SOWP
otherwise, you should apply for work permit extension immediately and wait for the decision, do not apply for SOWP unless the extension is rejected

>>> I have done whats required but it says within 30 days after the marriage is done. That was 28 September when we got married. Yes if it comes before that I have everything else ready to apply for PR.

No, I simply do not recommend apply for two different work permit applications at the same time. Not sure if anyone else's having experience on it.

What you plan to do with work permits will not work.

Do not apply for the work permit extension. You don't qualify for one and you'll just end up in Canada without status which will complicate things.

Two options.

Either submit a complete spousal sponsorship application and OWP application before Nov 9th. Or if that is not possible, apply now for a visitor record and then stop working once your current work permit expires. Then once you have submitted the spouse sponsorship application and have AOR, you can apply for a new open work permit.
