Hi there, looking for some advice.

My wife has been in Canada on a TRV since October 24th, 2019. April 24th, 2020 marks the 6 months she's allowed as a visitor (they didn't give her a visitor record, and didn't even stamp the passport).

We received passport request on March 12th, 2020 and sent it off. It arrived at CPC-Ottawa on March 13th, 2020. No updates since.

The problem is, do we need to extend the TRV? and if we do there are some documents we don't have (needs a copy of the passport and all the pages with visas and stamps).

The next problem is even if we get the passport back before April 24th, the border is shut so we can't flag-pole, does that mean then we need to extend the original TRV?

Any insight would be appreciated.

1. No you don't extend the TRV, you apply for an extension as a visitor. See: https://www.canada.ca/en/immigration-refugees-citizenship/services/visit-canada/extend-stay.html

You don't need to extend TRV, but may be to extend her visitor status; you will need copy of her passport pages to do so.

Did you receive PPR for a PR application? if so and it was approved, you might not need to extend her stay as visitor.

You can send a a LOE via webform once you receive the passport and cannot flagpole

Why do you need to flag pole if you get the passport back? Sorry a little hard to fully understand situation without more details of status. You had a sponsorship application that was approved?

Either way under the circumstances there is leniency at the moment so I wouldn't worry about extensions. Send a webform to cover your butt... That's all

OP is talking about flagpoling to land as a PR. The sponsorship app has been approved and the passport has been sent for stamping.

Oh ok. They just have to wait it out...or can't they land at an airport? I think I saw someone do that. Anyhow they wont have problems with status the new update said if your in the country right now legally can you stay? and it says yes.

Hi thanks for your reply. Yes, we received passport request on March 12, and the passport arrived at CPC-Ottawa on March 13th. In the passport request email it says "As you have now received a Confirmation of Permanent Residence (COPR) or have been notified to submit your travel documents in preparation for the issuance of a COPR ".

We haven't received the passport back yet, and the return tracker hasn't been updated yet.

My wife's application was from outside of Canada, but now she's in Canada (on a visitor visa [dual intent]) . So we will have to either exit and come back in to validate the PR, or do it through a immigration office appointment.

I don't have a copy of all of her passport pages as required for the visitor extension. And also it says "you should apply at least 30 days before your current status expires". Which is today, so I'm wondering if I should just submit it now even though I don't have a copy of all the pages. Or wait until I get the passport back which I don't know when that would be.

You can apply to extend her visitor status until right before her current status expires. You don’t need to apply 30 days before

Thanks for your reply. That's what I thought, because it says "you should" and not "you must". Hope they send the passport back soon, doesn't look like the border will open up anytime soon though, so flag polling is out of the question for a while.

On the off chance that she doesn't receive her passport back within a few days of her current status expiring, apply for the extension anyways with a Letter of Explanation that she doesn't have the passport copies.
