Dear Leon, Alabaman, PMM and others,

Before I will make another mistake with my Canadian PR, I would like to know your opinions.

Me and my husband landed in May, 2009, as per PR card it will be expired on 12May, 2014.
I spent 146 days-4M 22 days in Vancouver BC, still remaining 584 days to reach residency requirements 730 days.
My husband is working in third country and I am recently with him and our baby, she is Canadian citizen. I decide to move back with small baby on Oct12, my husband will be stay and continue his work in the third country. I cannot move earlier since we have Canadian medical debt and would like to save some money to cover the debt. In Canada even I have million debts, I cannot extend my PR, only I should present 730 day to preserve my PR.

My schedule is very tight, if I will move in Oct12 I will have to stay without any travel oversees to meet 584 days remaining. Question: YVR immigration officers will ask me about my residency they are very strict, I already passed before and know how many questions they are asking. If they will see that I am very tight with my remaining days, can they revoke my PR at the airport? Do they have right to report me if I was out of country exactly 3 years? Should me show them my excel sheet which I prepared for counting my presence in Canada. I realize that they have all landing records and cannot cheat them.

The main problem with my husband, he cannot stay with us to continue his job oversees and support us financially. He plans to travel to Canada every 6 month to visit us till his PR will expire. When he will be entering each time to Canada till 2014, can they stop him and report at the port entry, since he did not meet 730 days and spend only 2 month for past 5 years, but his family will be staying in Canada? What should he say at the port entry that he is visiting his family and working oversees?

In case PR will be revoked, can he visit us by visitor visa? At the meantime my PR will be expired and I cannot sponsor him, as per CIC requirements I should provide: Both sides of PR card, landing paper, confirmation of PR. I will not be able to work with small child but I will try to find job, but it is not easy with job in Canada, day care expences would be higher that my salary. How can I show them that I really can support him financially or it is not required? How can he enter to Canada? Please advise us.

In case he will enter to Canada and his PR will be reported at the airport, can he stay illegally in Canada? Do we have any ways to extend PR? Can I sponsor him while he will be inside the Canada?

Appreciate if you will put your comments on my issue since I have to make right decision for avoiding of losing my PR.

first please let us know in which year your hubby finally intend to settle in Canada permanently? Or he wanna continue the same trend to visit you in Canada off and on for indefinite period?

Dear L7,

He will continue travelling forth and back, no other choice. I saw how people cannot find job over there and he is really scared that will not be able to support us financially. Very sad. But I do not see other choice, do u have any idea?

They can not revoke your PR immediately. What they can do is if they suspect that you do not meet the requirements at all and have no chance to do it, they can report you for it and start proceedings to revoke your PR. They will still let you enter Canada and you can appeal their decision. However, from what I hear on this forum, it seems uncommon that people are reported. You may get a warning that you must stay in Canada now or you will lose your PR but that will probably be it. You should tell them that you know you have stayed outside Canada for exactly 3 years and that is why you have come back because you know you must complete your 730 days to keep your PR.

When it comes time to renew your PR card, you should not apply until you already have the 730 days in the previous 5 years. If your PR card expires before you can apply for the renewal, that is fine. You are already in Canada and will not need your PR card in your daily life.

As for your husband, he can travel to Canada until he loses his PR and after he loses his PR, he can apply for a visit visa. If he has problems getting a visit visa, you can sponsor him for PR again (you can only do this after he has lost it officially). You do not have to show income to sponsor him. There is no specific income requirement for spousal. They want to know that you aren't going to starve but they see that he is working so they will figure that if he moves to Canada, he will also work in Canada.

Dear Leon,

I was reading that many people has chance to enter to canada even with last day before expiration their card, but ussually I am not such lucky person, I am already punished wih my debt.

Leon, I got job offer for 1 year and was wondering to work till Dec12, so I will be late to meet my residency for 60-90 days. Do we have another way to enter to Canada, avoiding entering thru airport, just note that I have small kid with me. I am thinking to take risk and sign contract for 1 year since we have to cover the debt and the same time I am realizing that immigration officers does not care about my problems, they just can report me. There are some posts where people are using machines at YVR for entering to Canada, but I have small citizen with me so I cannot just pass thru immigration officer since her passport should stamped as well.

Your only other option would be to fly to the US and then drive across the border. However you'll still have to pass through customs and speak with immigration officers.

I've noticed that when requesting assistance, information or advice, many posters often refuse to name their nationality of origin or citizenship. We're all anonymous here ... there might be perfectly good reasons for doing so, but I can't figure out why so many appear to be so reluctant, and instead awkwardly refer to their "home country" or "third country".

There's a lot of good advice to be dispensed in this forum, much of it from individuals who've experienced very similar situations to the ones that posters often ask about. In many instances requirements, policies and regulations can differ significantly depending on an applicant's specific nationality. I'm sure I'm not the only one who has thought to him/herself after having read a post for help in a particular situatiuon, "I sure do wish I knew exactly what nationality the OP is, because if he/she is _____ (Chinese/U.S./German/Filipino/etc.) I know of a way that ...." By way of another example, if I know of a certain procedure that's only available to U.S. nationals, let's say, then I won't needlessly contribute a lengthy post if I know that the OP is from India. This not only saves me time, but also prevents possible (and needless) confusion or false hopes. I

For those of you who routinely omit their nationality from posts, I'm genuinely curious as to why you feel this is necessary. If you have any specific reasons for doing so I'd appreciate you sharing them (maybe I'll learn somethng!) Altough some posters might sometimes appear rude, judgemental or disrespectful in their responses to inquiries, I firmly believe that the vast majority here want to be helpful.

Bottom line: I believe that the best way to get a good, knowledgable respose to a question is to provide as much detail as possible in an original post. The country of citizenship in particular is often vitally important/significant.

Then your only option is to fly to Canada, go through Canadian customs / immigration at the airport and hope for the best.

Leon's answer above is what you should go with. I don't think you will get any better advice besides that.

As of today, it is NOT likely that you would have problems coming into Canada because the immigration authorities usually don't check residency obligation. This has been my experience. However, nobody knows what it would be like in a year's time because there are a lot of changes going on with Canadian immigration by the current government. It might still be like that or they might decide to start enforcing the rules. No body knows. If you'd ask me though, I would say it would still be the same way... which means you are still likely to come into Canada without any problems next year.

Anyways, refer to Leon's earlier post above and make your decision.
