My parents are deceased, can I sponsor my sibling?

Hello everyone,

I came across this forum looking for information. I am a permanent resident in Canada, and I wish to sponsor my adult brother (he is unmarried and no kids). Both our parents are deceased, I have no children of my own, and my husband is a canadian citizen. Under these conditions does my brother qualify to be sponsored?

Unfortunately you cannot sponsor your brother since you have a husband. If you were single, with no children, your parents were both deceased and you had no family in Canada (e.g. no aunts, uncles) - then you'd be able to sponsor your brother. However since you have a husband, this disqualifies you from sponsoring your brother.

I thought the reason why a spouse would eliminate the chance of sponsoring a different family member, is if that spouse was not canadian, thusly you would be obligated to sponsor your husband/wife. But my husband is a CANADIAN CITIZEN and it's obvious he would not qualify for me to sponsor him. So you are saying that even under those circumstances I cannot sponsor my only living relative?

Correct - you cannot sponsor your brother.

This rule is often referred to as "the lonely Canadian rule". One of the criteria to qualify is that you cannot have any family in Canada. Your husband is obviously a family member - so unfortunately you don't qualify. The fact he is a Canadian citizen is irrelevant.

I see. So if he's not available through any other of the programs to come to canada himself, what would you recommend? Provincial Nominee? He does not qualify for express entry, (also he is an american citizen, I don't know if that makes any difference, probably not)

For immigration purposes, the fact he is an American doesn't give him any advantage. The only place where it may give him an advantage is in applying for a temporary work permit. If he's able to secure a full time job in an occupation that falls on the NAFTA list, then he can apply for a work permit without having to also obtain an approved LMIA.

If he's looking to immigrate, then he will need to find some way to qualify on his own. If he doesn't qualify under express entry, then yes - I would take a look at the Provincial programs. There's a whole section of this forum dedicated to discussions about the PNP programs.
