she is overstay her visitors visa in the US. she has a Bachelor's degree in Business Admin majoring in Human Resource Management. is she qualified to apply for skiller worker programme?
she wants to apply from within the US. Can She?

1. To apply for FSW she must have at list one years experience in the "list of 38" http://www.cic.gc.ca/english/department/media/backgrounders/2008/2008-11-28a.asp
2. Unless she was admitted to the US for 1 year on her initial entry, she can't apply in the US. Note all FSW applications go to Sydney NS first.

so u r saying she is not qualified because she only get 6 months on initial entry
what if her job is not in the 38 can she still apply from her home country?
what if her job is not in the 38 and she gets a job offer can she still apply from her home country?

1. No thats not what I said. If she was admitted to the US for 6 months, she can't use Buffalo as the processing office, she has to use the office that services her home country.
2. No, if her job is not on the list, she is not eligible to apply.
3. If she gets an Arranged Employment Offer from an employer in Canada, certified by HRSDC, then she can apply from her home country.
4. Read the instructions, all FSW applicant submit their preliminary application to CIO Sydney.

Can she apply through her home country but not go back there?
Can she just send the application there, then when the process is over she go there and pick up the documents
She has an address there that she can use. she is trying to get to canada without returning to her home country

To apply to a visa office in a country, you must have been allowed into that country for at least one year (not visitors visa). Even if you are not there for a year but you were allowed to go in for a year, then you can apply. Your friend wasn't admitted into US for a year so cannot apply through buffalo visa office. Your friend can apply using the US address with the CHC in his/her home country as the visa office BUT she would have to get a US police certificate (i think) but what would her PCC say if she is here illegally.
