Hi i have a question for you guys. i applied for PR under CEC in May 2010. in Aug. 2010 i got a file number, but in March 2011, my file is transferred to seattle. they said to speed up processing files. but my 3 year PGWP will expire in July 2011. i only have 2 month left.
i phone CIC and they said i cannot extend PGWP. so i asked my boss to file form to LMO. am i able to get PR in 2month? able to renew my work permit? don't know. please give me some idea thought guys!!!

It is possible your PR will be done, but not likely. If you want to continue to work past July,

1) Your boss must apply for an LMO.
a. Because you were initially hired under the PGWPP, your boss does not have to demonstrate recruitment efforts before applying. On the application form asking about recruitment efforts, your boss should write something like "originally hired under the PGWPP."
b. Your boss does have to indicate "YES" to "intent to permanent."

2) Your boss should apply for the LMO ASAP. You might not receive a response before your work permit expires. In that case, you are permitted to apply for a new Temporary Work Permit with the LMO pending, ONLY within the 2 weeks prior to the expiration of your current work permit. But you must submit the application to extend BEFORE your current permit expires.

3) You will not receive the TWP before the current one expires, but that's OK. Once you have submitted your application for a TWP, after the current work permit expires, you will be in "implied status" - you will be able to continue to work under the same conditions as the expired work permit, as long as you do not leave Canada. If you leave Canada before you receive your new work permit, your "implied status" is terminated and you will not be authorized to work.

4.a. If you get your new work permit, you must realize it is different from your PGWP - it will be a closed work permit, meaning you can only work for the same employer, in the SAME position for which you received the LMO/work permit. Any changes require a new LMO.

BUT -

4.b If your application for a TWP is refused, you will have to leave Canada immediately, because you will instantly be "out of status."

one of the thing i am scared about is that my file is in Seattle. i have two friends who went to Seattle for a interview under skilled worker. they said interview was awfull.
hopefully i dont need to go there. but who know eh.
one more question is that if my PGWP is expired, am i able to stay in Canada as a visitor? i can apply for visitor visa eh?

You can apply to change the conditions of your work permit to visitor status (I think it needs to be a month before the expiration of your work permit). So, you'll have to decide if you want to continue pursuing a new work permit or a temporary resident visa...

Fortunately, most CEC applicants have the interview waived :)
