I'm an ESL teacher, and two of my students (husband and wife), took and passed their CELPIP test. The husband's job category is NOC A, and the wife's is NOC B. The husband needed at least 7 and the wife needed at least 5.

During class last night, they mentioned speaking to an immigration lawyer who told them that if their employer doesn't get the ball rolling for them in terms of applying for PR, that they could apply on their own, but would then need to re-take the CELPIP test and get a score of 10 in each category. Has anyone ever heard of this?

No, there is no such requirement, see http://www.cic.gc.ca/english/immigrate/skilled/language.asp - 7 is enough for 0 and a, 5 is enough for B.

Assuming they meet other requirements (relevant work experience, etc) and have enough points for Expres Entry either of them can apply. With employers help (labor market impact assessment) EE points are no longer an issue - LMIA + job offer is worth 600 point and you need less than 500.

I wish there was a way to report lawyers for being incompetent - we don't do this for a living and we seem to know more then them about the process..

They meet the minimum requirements for express entry, however, they also have to meet the minimum requirements of one of the PR programs, and they have different requirements.

If your students are eligible for CEC, then they meet the minimum language requirements.

However, if the lawyer was referring to the FSW Program, they are awarded a different # of points based on the CLB level, and a minimum of 67 pts is required to be eligible for FSW.
