If he is married, he no longer qualifies as a dependent anyway. Were CIC notified that he is married? If not, they must be informed.

he is not married..anthing is settled in CIC..he has his visa already and the only thing for my family to do is fly here in canada..would it be possible that only his mother and brother land here by mid january? he doesnt want to go and he is begging me..please reply..

Then, why did you say that he has a wife and a son?

He can tear up his COPR document and not go to Canada. It is not mandatory for him to go. I still suspect that CIC are not fully aware of his status and possibly the existence of the child. Has the child been medically examined?

yes the child did medical examination..i have said he has a wife but i what really mean to say is girlfriend..he got his gf pregnant but the are not living tohether so my son is declared as a dependent..i sponsored a family sponsorship which includes his mother and brother..would it affect if he refuses to go with them? he wants to stay in the philippines so bad..what can i do? hope you can clear things up for me..

As he is not the principal applicant, there is NO requirement for him to become a permanent resident. He can throw his COPR document away and it will not affect his mother or brother.

It will not affect you if he doesn't land. However, he should because he is getting a chance to be a PR. In a year or two, he may realize that he made a mistake. He will be overage or married by then and you will not be able to sponsor him. However, landing as a PR means that he could still go back to the Philippines and think about it. He can be outside Canada as a PR for up to 3 years before he would be in breach of the residency obligation. If he chooses to come to Canada later on after having lived with his gf for 12 months or after getting married to her, he would be able to sponsor her to Canada as well as his child.
