My Application Return by buffalo office

Hi ,

I applied for PR under federal skilled worker and I filled up Simplified Application for Skilled worker form, My application returned from Buffalo office, they have told me that buffalo office not accepting the simplified application for skilled worker (because of the new rules) . I applied on 1st Dec, I applied using NOC Code 2174. I am a computer Programmer & Analyst. I have 14 years of experience. Right now i am in USA on H1B Visa. Can i send the Regular skilled worker application (IMM 0800) to buffalo office or some where else? Could anyone can respond?.

The simplified application process is NOT applicable in Buffalo Office. You can try in the normal procedure.

First of all, Buffalo was NEVER using the simplified application. Buffalo was using the regular application opposed to everybody else using the simplified. Always make sure you read your application guides properly before you apply and make sure you check back on the CIC website as well. You don't want to print out forms and send them in months later when they may be outdated.

That said, the rules have changed. There are 3 categories now that can apply for FSW. One is if your job is on a list of 38 most wanted occupations. Programmers are not there. Two is if you have a job offer in Canada. Three is if you are already in Canada for a year or more on a work permit or student visa.

Your chances to apply for FSW are in either having a job offer in Canada as a programmer or having at least 1 year experience in the past 10 years in some job on the 38 list. For example, if you can call yourself a 0213 Computer and Information Systems Manager, you could apply. The list is at http://www.cic.gc.ca/english/immigrate/skilled/apply-who-instructions.asp#list

Another way for you to apply for immigration would be to go through the Alberta H1B program. Their website is at http://www.albertacanada.com/immigration/campaigns/h1b.html but your job would have to be on the wish list for Alberta and computer programmers are not on there but if you could call yourself 2171 Information Systems Analyst or Consultant you could apply.

Other option if you speak French would be to see if you qualify to apply for QSW, Quebec skilled worker.

So now i have to apply yo Sudney Canada.Right? And i need not to send any documents along with it. OR By any chance i can apply in buffalo. If you are applying under FSW1 you HAVE to apply to CIU Sydney, you don't have a choice.

Just follow what they say. Fill regular forms attach 550 CAD DD and send again.
