I have joined a Gym and signed a contract for one year but now due to Medical Reasons i cannot continue and wanted to cancel the contract.
I try to cancel by showing them the letter issued to me by a specialist Doctor but they refuse to cancel the contract unless I pay the penalty of
$ 300. So what is my remedy because I am unable to perform the contract due to impossibility of performance which in English Law that is British Law,
it is known as Doctrine of Frustration and in this case the promisor is excused by Law to perform the contract. And it is not a breach of Contract.
