I'm very nervous about my situation. I applied under the provincial nominee program on March 7 and on July 3, I received a letter from the MPNP saying that they need some clarification in my provincial application. They were saying that I didn't go to college here (which is correct, but my husband did) and that I need a job offer with a minimum one year contract (which I have). But they are thinking that I'm applying under the "career pathway" when I'm actually applying to the "skilled worker"
The strange thing here is: I attached the company document, my letter of employment I attached my husband graduation letter. I don't understand why they select me under the "career pathway program" If I applied under the "skilled worker program"
Here is the letter they sent to me
" In your expression of interest (EOI), you declared that you:
graduated in the past 3 years from an approved post-secondary program in Manitoba
from a minimum 1-year program of full-time coursework; AND
have a full-time job offer from an eligible Manitoba employer, with a minimum 1-year
contract, in an occupation on Manitoba’s published In-Demand Occupations list that is
consistent with the post-secondary program you completed in Manitoba; AND
have at least CLB/NCLC 7 (or equivalent) in all four-skill areas.
The following concerns were noted in your application:
Based on the documents you provided, you have not demonstrated that you meet the
Career Employment Pathway (CEP). Specifically, you have not completed a post-
secondary program at a designated learning institution in Manitoba; AND have not
obtained a minimum CLB 7 in all four-skill areas, particularly in Speaking where you
scored CLB 6. "
Here is my response:
Regarding the graduation from a designated learning institution in Manitoba, when this was asked to me on the EOI I misunderstood the question as presented it was as such:
“Select all connections to Manitoba that you or your spouse have:
Completed post-secondary education on 8 - 12 months in Manitoba”.
This leads me down the path where, even truthful, the answers were not about me but my husband. He recently graduated from a 12-month program at the University of Winnipeg. I came here accompanying him with an Open Work Visa.
My intention was never to go through the “Career Employment Pathway”, but to go through the “Skilled Workers”. I was applying for this program, and from the moment of my EOI until now, I fulfill all the requirements for this program.
Temporary Foreign Workers
Required documents: In MPNP Online, you must upload copies of your valid work permit and, from your Manitoba employer, written confirmation that you’ve been working full-time for at least six months continuous, as well as your job-offer letter, specifying salary/wage and details of the position, signed and on company letterhead, along with all other documents described on the page Documents.
Conditions:
The offer of long-term employment must be from the same employer for whom you have been working full-time for the required time period.
I started to work on August 27, 2018 and applied under the nominee for Skilled workers on March 7, 2019.
You must have all the qualifications for the position including training/education and any required licence or certification. - I have completed marketing education back in my home country.
You must have job-ready English; specifically, you must demonstrate the English or French proficiency to fulfill the duties of your job description. - Since the immigration to Manitoba requirement have not changed for NOC A, which is the current NOC I’m under, as far as I know, I’m not obligated to take a proficiency test. I only did it to increase my points.
Your connection to Manitoba through employment must be stronger than ties you may have to another province. - Moving to another province has never been our intention, we are settled in Manitoba and my career plan and my daughter’s well-being are the two things Manitoba has offered us. As each day goes by, we are even more sure we wish to stay in Winnipeg.
You must demonstrate in a Settlement Plan your intention and plan to live, work and establish your work and family life in Manitoba as a permanent resident. - I’ve attached my plan into my immigration process.
It was not my intention to apply under any other program, but an accident when filling out the application.
My employer is fully committed to my situation and it will still support my application as I play an important role in the company’s operations, I deeply, truly hope this explanation together with the documents I’ve attached, is enough to meet your expectations in terms of explaining myself - it was never my intention to apply for any other program other than the skilled worker, the one I was fully aware I met the demands to.
I hope that a positive decision can be made where the program officer can see I do meet the criteria for the “Skilled Workers” program but that I’ve made a mistake on my EOI. I’m available for an interview or any further documents me and/or my employer should provide. This is a very delicate step in my family’s life and also our life plan of immigrating. Please accept my sincere apologies, I hope we can make amends so I don’t completely lose my status and the life we’ve been working on to build in Manitoba.

I'm very nervous because I'm currently working under implied status (my husband didn't get a job with a NOC to qualify me for an open work permit) I'm just concerned about my situation because I'm under implied status and I depend on the MPNP to approve my application while I'm still under implied status in order to go to the border and get my closed work permit there, without losing my job or going to the process of restoration status. If they refuse my application I will not be able to apply again because I don't have a valid permit.
Do you guys think I have a chance to receive an approval from the MPNP?
My employee is okay if I need to stop working for 3/4 months and request a closed work permit, but I need to receive a positive response from the MPNP. Anyone here with a similar case?
