Hey guys this question is for my friend!! She will get her PR only by Sep and she has to move out of the province due to admission in an university in another province. Is there a time or something you have to wait after PR approval i/e does she have to wait until PR card? or she can move out once she has cleared her entry with local immigration officer. Your help is greatly appreciated as she has to decide whether to apply for the university or not. Thanks guys!!

When she applied for pr under pnp, she had to sign a declaration to establish sucessfully in the province that nominated her. The province nominated her because she can benefit the economy of that province immediatly after landing based on her existing experience and qualifications. If she tried to study out of province right after landing, it is a seious break of her legally abind declaration. She will never be able to apply for citizenship in the future and in the next time she goes oversea and return to canada, her pr will be revoked and she will be deported back to her home country. Please refer to the new immigration bulletin in feb 2011 from cic regarding pnp nominee move out to other provinces for more info. The best is to wait 3 years till you get the citizenship before moving, not counting the time to process the citizenship application

Letina could you expand on this please? I have heard differently (from cic officer) but that doesn't always mean anything because I have had contradicting information several times. Could you maybe share a link to the bulletin because I can't find that on the cic website either. Thanks!

I am not agree to Latina..Here is the Info I provided to someone here on this forum earlier...

1. How much time till we receive MNC from Manitoba ? (MNC means Nomination Certificate)

Almost around 4-5 months if they don't ask for additional docs, otherwise add another 1-2 months ...

2. How much time will it take for getting visa from CHC Delhi once we apply to them ?

Another 6 months

3. Is it compulsory for being called for interview under PNP category ?

Not Compulsory.. They used to visit earlier at work place and they start calling.. Now it depends sometime they calls or sometime they don't.

4. Is it compulsory for staying in Manitoba for a specific time period if one is immigrating under PNP category OR can I move on anywhere else in Canada after getting PR cards for self and family ?

It's not compulsory but it's intended to be settled in Manitoba..

Yes you can move anywhere within in canada once you get your PR but keep in mind..

Peoples they don't read carefully, Look at MAS( Manitoba Affadevit Support) for better understanding, When any sponser signed affadavit, that means MPNP sponsered person suppose to be staying in Manitoba, if not It means sponsered person did not intend to live in manitoba, hence Orignal sponser who signed affadevit would not eligible for sponsering another person in future.

5.How much time will the authoritiws take in issuing PR cards after we land in Manitoba ?

Once you landed, it will take around 25 days to 60 days

Letika is right but this applies if she leaves the Province 'before' Landing. Any time her process is being processed, CIC can inquire with the Province. I consider it NOT ETHICAL to leave the Province before get the PR Status. Province can revoke its Nomination anytime if they want to, if they come to know about this. It is just NOT RIGHT to leave the Province. Have some ethics and responsibilities when you sign a declaration but again you are NOT bounded to stay after you get your PR Status.

I completely agree, she will not move until she does the landing procedure. I just wanted to know the procedure and rules involved. So as per the rule there is no requirement to stay in a given province until citizenship.

What I'm confused right now is does it mean PR from pnp cannot move to another province until they get citizenship?

NO. They can move immediately after Landing (after PR Approved). They have to stay in CANADA for at least 2 years within 5 years to be eligible for applying for Citizenship. Thanks

I am sorry. Yes. I was thinking of my case - 1 year (maximum) is counted if you have stayed in Canada prior of PR. So, Yes - 3 years if you have nothing prior. My apologies.

It is not true that as long as you get the PR card you can move to any province without any consequences. It is true, however, that you can live anywhere in Canada with your PR status but everything will be in your immigration record which is permanent and linked to your Social Insurance or Health Card. If you are out of the province for 6 months, you will have to apply for the health card in the province you are living in. In the past few year, CIC have been monitoring the large number of abusers who take the PNP as a stepping stone for queue jumping, in Oct last year, a new technical bulletin have been published which gave instructions on examining PNP PR at the port of entry for preventing this trend: http://www.cic.gc.ca/english/resources/manuals/bulletins/2010/ob251.asp

Please know that any abuse of the system will be taken seriously and will be recorded in the immigration record of each individual. Not only it will immediately invalidate the eligibility of your sponsor to sponsor another one, but also on your ability to sponsor your future dependents as well as your chance to become a citizen/re-enter Canada in the future. There is no free lunch for queue cutters, if you are going to Canada through the PNP route, it is your responsibility to live and establish sucessfully in the province that nominated you:

I am not saying that Letina is WRONG. She has a very diplomatic tone in her message. I consider that as a very generic response like all Government has. Such a tone is taken as a disclaimer for Government.

I attended the Session that SK Government provided for propagating their Nominee program and one of the Student asked the same question to the Government Employee and his response was the one that I provided.

I agree with Letina but there are rules that Government obeys too. Thanks

Latina i agree with you and you are absolutely right. i have request to all PNP nominated persons, please stay in the the province who has nominated you and play your role to promote the economy of that province.
