Mother in law is on Tourist visa in Australia, Wanting a Visa for Canada

Hi Fellow Members,

My MIL is living with her Son as a tourist, we're expecting our first born in a few months and thought it will be helpful for my wife if she's around for a couple of months. Would the process differ for us to apply for her Canadian Tourist / Super Visa knowing that she's currently in Australia as a tourist?

She doesn't intend to return to India for the next few months for sure.

It will differ as her current immigration status in Australia will not be helpful for the application, especially since you describe it as "living with her son as a tourist," which is not something you can do in Canada..

Additionally, the visa officer will be concerned that your mother will be coming to care for the child - which is considered work in Canada, and something that foreigners cannot do without a work permit.

To some small degree, yes. I won't suggest that it would be the thing that decides the application or not.

One of the major things needed for a visitor visa to get approved are ties to her home country. If she has been visiting Australia for the past few months at least it is much harder to prove those ties and that she intends to return home. You can of course try and see what happens if she has no plans to return to India any time soon.
