Misrepresentation ?

We got ITA on May 4th. My wife didn't include my kids by my previous marriage on the profile, so I want to decline the ITA and make a new profile, but my wife wants to submit the application with a letter of explanation. She wants to say this was an honest misunderstanding, because she didn't think my kids were part of her family, as they don't live with us and they are not coming to Canada. Also on the profile form it doesn't clearly state spouses kids should be included. What do the experts things, would CIC accept this was an honest misunderstanding or would it misrepresentation?

If her children aren't part of your family, don't live with you, and will not be coming to Canada, you may be OK. You don't have custody of these children?

If you have legal custody (even if it's shared custody), it's more complicated and you may want to consult a lawyer.

Hi, thanks for your reply. Note my wife is the lead applicant, I live with her and my daughter. No, I don't have custody or shared custody of my kids, they don't live with us, and won't be coming to Canada.

You need to mention the kids in the application even they are not accompanying you.

they are his kids not hers, she is the main applicant, CIC asks about her children (primary applicant) and whether they are accompanying or not not his.

I think you should be fine, but if I were you I'd check with @legalfalcon and/or @DelPiero07 as well.
