Mis-calculation of Points by London Visa Officer

Hi,

Today I received my all documents back from London visa office including refusal letter.

The visa officer has allocated me the following points:

Education = 20
Age = 10
Language = 10
Arranged employment = 0
Experience = 21
Adaptability = 04 (wife education)

Total => 65

Whereas, he has not given me 5 points for the close relative (my brother is Canadian permanent resident) and I sent his permanent resident card copy with my application for their review.

If he had given me 5 points for brother, my total points would be => 70

Now what shall I do? Clearly, it's a mistake of visa officer, who has not carefully awarded me points.

Can I write them to reconsider my case?

Just to clarify did u provide birth certificates for ur self and ur bro.....this would help in proving ur relationship wid him.

But just proving relationship is not enough.....you also need to provide proof of his residency out ther in canada which includes lease agreements, most recent Notice of Assessment from the Canada Revenue agency,monthly bills, credit card invoices and bank statements,etc.

I'm sorry but if u have provided only PR card ....then VO is not wrong

Actually if I am not wrong in 2010 it was not required to send these details with application.

Just recently it has become mandatory to provide lease agreements, most recent Notice of Assessment from the Canada Revenue agency, monthly bills, credit card invoices and bank statements,etc. to show that relative is currently in Canada

But kindly suggest me now can I do something? Or my case is closed forever?

dear I can't comment if it was mandatory or not to provide these details in 2010 or not.....

frm wat I know.....these details needed to be included in the supporting docs .......wat u can do now is ask ur bro to provide copies of birth certificate,lease agreements, most recent Notice of Assessment from the Canada Revenue agency, monthly bills, credit card invoices and bank statements,etc. and write a letter to the visa office within 30 days to reconsider ur case.

I hope and pray that VO opens ur appln once again and in the meantime wait what others have to comment on tis situation as well....all the best

You missed two other types of documentations;

1. You didnt provide any document which shows that he is your brother.
2. you didnt provide any documentation that he is currently residing in Canada.

This way as you did anybody can give anybody's PR card and say he is my brother without any proof they will not accept this, you try to contact them and explain your concern.

I did provide them B-form and his permanent residency card...
in 2010 it was not mandatory to show that relative is currently residing in Canada. Since last year they have started asking prove of residency...

how many days after u got the "decesion made state" from "application revied and process started " ?

Did u get before this refusal letter any other letter stating that "we revieew your file and elligible to process" ?

You are done, try re-applying again. Even better, wait till July 2012 when new rules come out.

Hi mate,

Very sorry to hear about your case.Infact in order to claim points for relative ,one needs to provide 3 types of docs;

1)Docs to prove that your relative is a Canadian PR/citizen
2)Docs to prove that your relative is related to you.
3)Docs to prove that he/she is currently residing in Canada.

And you should try to provide as many docs as possible for all the 3 categories mentioned above.I am sorry to say that its not a new requirement,I submitted my docs. in July 2009 and provided all the required docs. as like you, relative s points were crucial for the approval of my case.

Though the chances of reconsideration are less ,still there is no harm in trying .Try to get all the docs mentioned by other members above ,from your brother ASAP and send them to London office ,alongwith a cover letter requesting humbly to reconsider your case.

Sometime in some cases CIC refuses a case and also give chance to submit document within a lime limit.

You can try writing a letter to ayyour VO explaining and providing further documentation for yoour Brother PR and current stay in Canada.They could accept it and reopen your case..IF you are LUCKY
But thats the best you can do at this point of time
