Minor travelling alone, IMM5646

Hello!

I am a student in Canada, holding a temporary resident visa.

My brother of age 17 wants to visit me (alone) in Canada for winter holidays.

While applying online, the checklist contains a document named Custodianship Declaration IMM5646, which as I understood, is for student permit applications for minors, since it requires information about the school in Canada.

I noticed that the aforementioned documents disappears from the checklist if the answer to the following question is "Yes":

- Are you currently, or will you be living in Canada with a parent or legal guardian for the entire period of your stay?

However I do not think that answering "Yes" to the question is correct since even though I am his brother, I am not his legal guardian. On the other hand, we cannot fill out the IMM5646 since my brother is not going to study in Canada. I searched the forum for similar threads but did not find satisfying answers, please help us out.

You're filling the IMM 5646 form incorrectly. You must answer 'Yes' to the question.

Your parents can appoint you as his temporary local guardian for the duration of his visit. It is not a legal guardianship but only assigns a temporary right to you.

Your brother must include authorization/consent letters from both your parents + copies of their passports + his birth certificate when he applies

The online application document checklist does not include authorization/consent letters from the parents. Will my brother still need to have them with him to cross the border?

As for minors traveling alone (or even with one accompanying parent), IRCC is quite clear on the documents which must be included in the TRV application.... and which are the ones I have mentioned in my previous post

My point was there is no option to upload consent letters from parents with their passport copies. The only optional document we could possibly upload is a letter of explanation. How should we proceed?

A letter of explanation will not work. Like I've mentioned earlier, consent documents are mandatory for a minor.

You can combine all documents (consent/authorization letters, etc + any other additional documents to prove that your brother will return to his home country, such as evidence of his school enrollment + tuition receipt + letter of financial support from your parents, etc) as a single PDF file and upload it in that space
