I am a US citizen and my husband is a Mexican national. We have two children together and he was recently deemed inadmissable to the US at visa interview for being in country illegally more than once and over one year. He has the ten year ban but is eligible to file for 601 waiver but has to wait ten years for the 212 waiver. Can we immigrate to Canada to be a family? Or will his inadmissability be a problem?
 
He can immigrate to Canada if you qualify (i.e. if you meet the requirements for one of Canada's economic immigration programs). He must ensure he's 100% honest about his US immigration history and US inadmissibility in the PR application.
 
That would be amazing. We are trying not to go to Mexico because he lives in the state of Guerrero that is considered the most dangerous right now. There are no schools for my children since we never bothered to teach them spanish and no work for me. Canada would be the best option and I would most likely be able to stay in the special education field. I am a teachers assistant in our local high school with children with severe disabilities and currently work one on one with a non verbal student with autism. I love working with these children and couldn't imagine doing anything different.
 
You should post your situation to the Express Entry section of the forum, as you will get better responses there on if you will qualify for immigration to Canada.

If you are a special needs teacher assistant, I think that would be NOC code 4413 which is skill level C which I don't think qualifies for Express Entry (but may qualify for PNP or other programs).

You may be under 4214 (ECE related) which would qualify under level B, but this highly depends on your education.

The info above is correct, skill level C jobs do not qualify for the Express Entry program To qualify for Express Entry, you must have experience in an occupation that is skill level A, B or 0. You'll need to confirm your NOC code (job classification code) and which skill level it aligns to. Agree that if Express Entry isn't an option, you would want to look at the Provincial Nomination Programs next. Some of these require jobs offers to qualify (which most likely won't be possible for you to obtain in advance) - however some don't.

I would recommend that you complete other preparatory activities soon like taking the IELTS English test and getting your education officially assessed.

Pide un reporte policial en Estados Unidos y México para tu esposo, El gobierno de Canada solicita, reporte policial para conocer si tiene criminalidad o reportes de seguridad (terrorismo).
Por otro lado los ciudadanos mexicanos solo necesitan eTA para entrar a Canada, no necesitan visa como turistas.

Unfortunately there's really no chance OP's husband will be approved for an ETA given his US immigration history.

Let's say he's approved (which is extremely unlikely) - what then? An ETA will only allow him to visit Canada temporarily. He won't be able to work here or live here or anything like that. They are looking to immigrate to Canada. An ETA doesn't accomplish that.

What is your's husband's profession and English or French language skills (written as well). Honestly it will likely be very difficult to immigrate as a teacher's assistant so I would look into it but explore other options as well. Depending on your husband's qualifications he might be a better primary applicant.
