Hi Everyone,

I am an american citizen married to a mexican citizen and have 4 kids and in the process of adopting 2, total of 6.

Husband is in removal proceedings in u.s. and will depart when told to. He has been here since 2000 and then again in 2002. We have tried to get fiancee visa approved but he has to wait 10 years before applying to enter again, b/c prior illegal entries.

He does have one and only one thing on his record from summer of 2008. Convicted of alien in possesion of firearm, class c felony, penalty was low end of standard range. U.S. Immigration Law states that an aggravated felony would make him inadmissable to the u.s. b/c he got 30 days and a one time offender it doesnt meet the requirements of an aggravated felony. Not for sure if this would be held against him for canada. Innocent mistake, wanted to go target shooting and didn't realize, honestly, that it was a crime.

He has worked (illegally) in the u.s. he has paid his taxes however. But he worked as a pipefitter/gluer/manufacturer person for 7 years. He is skilled in his job and gets paid good money. Dont know if that would be considered an apprenticeship or not.

He wants to come to canada BC, so he can be closer to the family. We are 15 minutes from the border.

Does anyone know what to do or have any advice for us. Can I sponsor him from the U.S. while he is in Canada? Maybe on a visitors visa.....

It's highly unlikely that he will get a visit visa to Canada after overstaying in the US. The criminal record thing is another problem. If he wanted to immigrate to Canada, there would be a slim chance if he gets a job offer as a pipe fitter and applies for permanent residency through a provincial nominee program but if he doesn't have papers as a pipe fitter, that can be a problem too.
