I had applied for CEC class in Oct 2011. I have recieved medicals for myself (principal applicant) and husband (dependent spouse, who is residing in India )..We have done our medicals. The question now is:

1) My work permit expires in MAy 2012....so do I have to resign my current job and apply for visitor visa to remain in Canada as my company has denied to give me an LMO ??? Can I apply for visitor visa from Canada or I have to go back to India and apply from there ??

2) My main concern is passport submission.I have applied to Buffalo and my file is now being processed in Ottawa. Incase if I return to India ...how can my passport and my husbands passport be delivered to Buffalo as none of the couriers in India are ready to deliver passports and it is illegal to send passports out of the country of residence??

Thank you...your suggestions will be greatly appreciated !!!

Try providing the LMO application plus instructions and ask if they would re-consider. Sometimes they refuse because of misinformation about the process. You can apply for visitor visa while in Canada but you would mail the application and your passport to the Canadian Consulate in either Buffalo, Seattle or New York. http://www.cic.gc.ca/english/information/applications/visa.asp

Having a PR application in process and applying for a visitor visa(i.e. dual intent) is not a problem but if they think you won't leave Canada when the visa expires, they may refuse to issue it. So the onus is on you to satisfy the VO that you will leave Canada when the visitor visa expires(assuming you don't have your PR status by then).

Contact the Indian embassy in Canada and ask if they have advice about mailing passports out of the country of residence.

1. yes, you may apply for a visitor visa while you are in Canada, and most likely you will be approved, but there is no guarantee.
2. If your visitor visa is denied, then contact the buffalo office and ask for their suggestion on how to mail the passport.

Dont over stress yourself!

Yes, you can apply from within Canada to extend your stay as a visitor:

http://www.cic.gc.ca/english/information/applications/visitor.asp

I'm not sure what to advise RE the passport situation, this is often a problem for Indian applicants. But - if your husband is in India, how will you get his passport?

To be on the safe side, your husband should write a letter stating that he has authorized your parents to carry his passport and deliver it to you in Canada. It should be signed and dated.

So my parents have to declare that they are carrying his passport with the authorised letter and get it stamped at the airport...will that be a goood idea...??? or dont say anything at the airport as I dont want them to go through the hassle of answering too many questions to the airport officers???

Once my husbands passport reaches Canada and when I am asked to send it to Buffalo for stamping.....hope they will not be concerned of how my husbands passport who lives in India got to Canada....and if they ask for proof...and if the authorised letter carried by my parents is not stamped ...there is no actual proof...hope that should not be a prob.......plz tell me what do I need to do ???

Since your parents will be carrying his passport and you are not sure whether it is legal, I suggested that your husband write a letter authorising your parents(their names in full) to carry his passport and deliver it to you. He should sign and date this letter. The airport does not have to stamp anything. Your parents don't have to mention it but in case airport staff see it and ask questions, this letter your husband wrote would be proof that they have permission from the owner to carry it. I hope it's clear now.
I don't think Buffalo is concerned with how passports get to them as long they receive it within the time frame indicated.
