medical Inadmissability

Hello, I am new here and currently in need of help. I am under LCP and now my application is pending and might refuse because my husband was diagnosed to have Chronic Kidney disease which at first we did not expected. They already send me a fairness letter dated March2016 and i already replied the letter without getting any advice from others because i thought it was just simple explanation, telling them that my husband aggreed to temporarily dropped his application so i could get my permanent... but when i started reading some forums here, i started to panic because iam sure my respond to the fairness letter is not convincing. Now, i am worried and need any preparations for whatever their reply. Until now i have not heard from cic yet. Please help me what to do, me and my husband decided agreed to divorce since our relationship is not same as before . we are separated for 10 years because i am here working and we only have that commincation for the sake of our son. but the problem is it was too late for me to file until this thing happened. The cic would think that it is a divorce for convinience.. but honestly not. we already agreed before that once they are here then we will file divorce, only for him to come here in canada because mostly of his siblings are here. now, i am affected and the worse is might refuse and leave Canada which i dont want to happen. i have lots of sacrifices since then. Please anyone could help me???? :( :( :(

I'm not clear what you said in your response to CIC. Did you ask them to exclude your husband from the application? Your husband has to pass the medical even if he is not accompanying you to Canada in order for your visa and your son's visa to be approved. If he fails the medical then you will be refused as well. The only way you could completely exclude your husband from the application is if you were divorced or in the process of getting divorced. However as you've said, this isn't a realistic option since CIC will know it's a divorce of convenience.

In your response to the fairness letter what you needed to do was prove to CIC that your husband won't be a burden on Canada's health care system. If you submitted your answer in March, I'm not sure there's much you can do at this point. Your best bet would be to hire a good immigration lawyer to help you with next steps at this point.
