Medical for common-law sponsoprship

hi guys

So we finished colecting all the necesary papers for my sponsorship

My question is : in document checklist , for sponsored person it says medical examination for me and all my dependants.
When my partner left to canada , she first sent all the documents , and then they required medicals.(immigration file )

I have to do them before i send the papers?
As for my dependants its a 3 year child who will stay here with his mother ( in IMM008 i clearly specifed that he wont come with me ! ) , do i have to make the same medical examinations???

Hi

Yes, you and your child must both have medicals done before submitting the app. It doesn't matter that your child is non-accompanying; he must still have a medical and be included in your app.

Understand that if the child doesn't undergo a medical, he will be forever excluded from the Family Class, which means that you will never be able to sponsor him to Canada.

If your ex will not allow the child to undergo the medical exam, you need to document this. If she has full custody, include proof of that. You will need a notarized declaration confirming that you understand that your child will be excluded and you will never be able to sponsor him. You can expect your app to be delayed, possibly significantly, as CIC does not like to exclude dependent children.

You should do everything you can to convince your ex to allow the child to have the medical.

Include a note explaining it. If possible, prove evidence (email, letters) that you tried but the child's mother refuses. I imagine this is a fairly common circumstance and is specifically mentioned in the CIC manual for it's agents.

Are you sure about that? Certainly if you don't list the dependent you will never be able to sponsor them. I haven't seen anything that says the same if you list them but can't do a medical.

Ok , so if i send a notarised declaration that i understand i wont be able to sponsor my boy , will resolve all my problem ???because i can do that today :)

second option : if i dont declare that i have a boy in imm0008 , its ok for them ? wont that be a lie ? and automaticly a refuse to my application ?

Yes, very sure. A dependent that is not medically examined is forever excluded from the Family Class.

No, it will not resolve all of your problems. As I said, CIC doesn't like to exclude dependent children, so you can expect that they will request more info and have you try to get the child to undergo the medical. Again, as I said, expect this to delay your app.

It would be beyond stupid for you to not declare your child. DO NOT LIE. That is a very good way to not only have your app refused but to be banned from Canada.

You should strongly encourage the mom to allow your child to do the medical exam, and offer to pay the fees for it. Children's medicals are quite simple, and takes very minimal time. In case something happens to the mom, having the child medically examined means that he can be sponsored to Canada at any time in the future before turning 19. If he doesn't do the medical then he can NEVER be sponsored ever by you no matter what.

So only proceed with excluding child as a dependent for not doing medical, if you have absolutely zero interest in ever being the guardian of the child should something happens to the mom, child has other people in his life that would take over as parent for him, or you would be prepared to return back to your home country to raise him.

You will need to sign a certified declaration and send to CIC, that you understand and accept that not doing medical exam for your child will exclude him forever from being sponsored by you to Canada no matter what happens in the future. You should also include fact that his grandparents would take care if something happened to mom which may alleviate CIC's concerns.

CIC still does not like this due to the possibility something could happen to all potential guardians of the child, and you as father would need to take care of him again. There may be delays, however CIC will usually accept it in the end.

Do you not have visitations with the child at all? I don't think the mother can refuse the exam if you do it whilst the child is in your care. I can't imagine not wanting to raise your own child, but I guess that's your business. I suppose it's a little personal for me as I gave my ex-husband custody of mine and have regretted it ever since. I would do anything to get them back. I got mine their medical exams on my own. I had to fly 1200 miles back to the US to do it myself, but well worth it. Please, think long and hard before doing something you may regret later. I hope your case goes well. Best of luck to you!
