hi, me and my girlfriend have already plans and our relationship is already more than one year, i am a PR already and my girlfriend is going to get a tourist visa to come here in canada and i will marry her here while she is on a tourist visa , and after our wedding i will going to apply and sponsor her already as a spouse we have a picture, messages to prof that our relation is real she is a filipina and we are planning to apply her PR outland.
QUESTION:
1: is it okay if she have a tourist visa and im going to marry her here in canada? is theres something for me to worry about that?
2:can she stay here in canada without leaving while we apply her PR outland ?
3:can she already work here in canada while we are waiting her applications to be approved?
thanks for the answers i really appreciate it .

There is nothing preventing her from getting married while on a tourist visa.

She would have to apply to extend her stay if she wants to remain in Canada during the processing.

As a visitor, she cannot work or study.

based on the reading on the forum, here is what i think....

1: is it okay if she have a tourist visa and im going to marry her here in canada? is theres something for me to worry about that?
Yes you can marry her in canada when she is on a tourist visa.....you may need to figure out the procedure to do so. you need a marriage licence etc
2:can she stay here in canada without leaving while we apply her PR outland ?
you have to keep her status legal during the process of her PR application, hence you need to apply for extension of visa. dont overstay - it may affect your pr application
3:can she already work here in canada while we are waiting her applications to be approved?
She cannot work on a tourist visa, however after PR application is filed - you can look into applying for a open work permit (not sure if it applies for PR - outland or inland). if she qualifies and gets approved she can work

the key is documentation for a PR application, hence make sure you do everthing by the book and keep copies of all the documents to submit with your application. Good luck!

If she applies outland, she cannot get an open work permit. OWP are only for Inland applicants. However, if she applies Inland, she would probably have to wait 13 months and longer to get OWP. If she applies Outland, there is a good chance she will have her PR in less than that time.

Thank you for giving me some advice it really helps me so much and by the what if we applied her pr on inland does she need to extend her tourist visa still ?

And guys can you give me some advice for what is the best thing to do ? If we are married here and we applied her application outland can she just stay here in canada until her application be approved ?

Yes, she can stay here as a visitor and still apply Outland. Just make sure to extend her visitor's visa so that she is not out of status.

Thank you kayaker , but kayaker if we applied outland is there any chance that she need to go back in the phillipines for any interviews or what?

There is always that possibility. But I haven't heard of anyone going through Manila needing an interview recently. Interviews seem to be more common in other VOs.

That said, in order to avoid an interview, I'd try to put together a really solid good application so that an interview wouldn't be required.

Interview is more likely if your relationship has large age difference, educational difference, cultural difference, no common language, quick proposal/marriage, marriage on first meeting, parents not attending the wedding, having a civil wedding rather than a full wedding, etc.

Best thing to avoid interview is to put together a solid application with lots of evidence.

Manila doesn't seem to have very many interviews compared to for example, Singapore VO. In Vietnam, it feels like 80% of applicants get interview, based on the # of people on this forum getting one.

You talking about the sponsorship?

Show lots of evidence of phone calls to your partner, emails, chat logs, love letters, gifts you bought for each other, pictures of you together, pictures of your families together with you and your partner, proof of tickets bought to visit each other, etc. There's so many things you can do.
