Marrying an Indian on tourist visa

hi,

I have recently received my COPR and would be in Canada by Jan 2018. I have a girlfriend back home and we plan to get married. But as my application was accepted as a single applicant, i do not want to jeopardise that status and would look to get married only after i have received my PR card in Canada. Could i bring her along on tourist/visitor visa, so she could stay and explore the country while i get my card and then we could solemnise our wedding in a canadian court after that? Would that stand acknowledged and could she then stay with me long term? Would then apply for her PR/TRV accordingly too.

Yes - you can do that.

To be approved for the TRV - she will need to demonstrate that she has strong ties to her home country (job, property, assets) and has no plans on remaining in Canada long term. If CIC thinks she has plans to stay in Canada permanently, the TRV will be refused.

Thank for your reply. But if we make our marriage legal in a Canadian court then too she has to prove strong ties with her home country? Will she have to go back to her hometown even after we have got married in Canada? Is there no way of keeping her back with me for a longer duration and applying for a legit pass then? Is there any kind of spouse visa application that a PR holder is entitled to?

If you sponsor her using the inland application process and include an open work permit application, she can remain in Canada while she waits for the PR application to be processed. If you have further questions about spousal sponsorship - you should start by reading through the discussions in the Family Sponsorship section of the forum.

The hardest part will be getting the TRV approved.

Sorry to post so many questions but it has taken a while for this marriage to finally be accepted by all and we would want to stay together from asap. But of course after getting all the facts and processes clear.
