Hello,

Me and my wife got married last july, were trying to start the application for me to live in Canada.

Theirs couple of issues, first one i am a Mexican citizen living in the US with an expire visa, not my fault, i was drag to the US when i was 6.
Is that an issue and how would i go to start the application?.

Hey,

There is a few people with similar cases, and it doesn't seem to be a problem. Your application will need to be processed through mexico, and you will have to go there if you have to attend an interview.
There is a senior member here with a similar case, and her husband got his PR recently, so she will probably jump in and help you out.
TO start the application - read the very first thread of this forum called "spousal sponsorship" by Leon, it will help you understand the general frame of the sponsorship process. You don't need to read all the thread, just the first post.
Then go to CIC website, and download the application forms here http://www.cic.gc.ca/english/immigrate/sponsor/index.asp, read through them, and start gathering proofs etc! :) it's a long process, but you'll find help here whenever needed, and unless you have a very complicated case ( more than just the illegal status in the US), you can probably do it without a lawyer.

Hi! My husband was undocumented in the US from age 9-32. He landed in Canada in August and is now a permanent resident. The application was actually easier for my husband than Mexicans living in Mexico. Because he hadn't been to Mexico since he was under 18. he didn't need the Mexican police clearance. That really sped things up. You will need to get FBI clearance since you have been living in the US. Put on your application that you are undocumented. Be completely honest. It doesn't affect your application negatively at all. We didn't need an interview - make sure you show a lot of evidence that your marriage is real. Pictures, letters from friends and families, stories etc. Just know that when you leave the US, you will be banned for ten years. However, it is possible to get a waiver so that you can visit. It is easier to get than the hardship waiver for a green card. We will use a lawyer for that most likely. Get luck, just fill out the application like everyone else. Having no status in the US will not hurt your chances of getting a Canadian visa. It is more about a lack of criminal record. GL!

Thank you canadiangirl 78, I am currently applying for deffered action for childhood arrivals.. I do not know if that affects me in any way. We are looking for all the papers we will need. Your story is very encouraging, was started to feel very depress I wouldn't be able to live with my beloved it. I do not have much of photos. We had an elopement, but we have some pictures of my wives trips to the US. Also we have about 8 years of chat history log and emails. I hope this helps.

My brother in law just got his work visa and drivers license. Exciting! That will not make it harder for you to get a Canadian visa. But you'll still be banned once you leave.

Quick question, Did your husband move back to mexico before he file the application or before? If i translate my documents in the US with a US notary will it still work? Also how would i go into doing the FBI clearance? Sorry. Trying to figure out what my timeline in the US and when to go back to Mexico.

He didn't go back to Mexico. That would have made the process take longer.

We didn't translate so I don't know.

Go to the FBI website. Just google FBI fingerprint clearance. You can print the forms there. We had fingerprints done at either ups or FedEx. Do it first cause it takes 6 weeks to get it.

Does it matter that in the 8 years my wife and i been together has been an online relationship? We have only been physically together twice.

No it doesn't matter but you'll have to work hard to convince them the relationship is real.

You have to do the FBI check but follow the Mexico guide as far as number of pics etc. Choose the Mexico City visa office.
