Marriage situation - with PR Pending

Hello kind folk,

I have a question regarding the PR visa and marriage. So I've met (online) and liked a guy who is already in Canada on the PR visa. We want to get married.

My PR is in process from Dec 2019 (long time I know). I do not know when I will get a result on my PR application. It's currently with the NDVO office. I've ordered GCMS notes on Nov 28th, and expect to get it before January is through.

Now, if we get married when my PR application is still in progress, then what would the next steps have to be? Both of us have to notify IRCC, I'm sure. Now does this mean my PR application processing would be expedited? Would I be able to land in Canada and live with my partner after he adds me to his PR?

I am a little confused about this, and would appreciate some guidance.

If you got married you would need to inform IRCC through webform, provide your husband's details and mention his PR status. It's unclear whether it would expedite your application's processing, it most likely would not change. It would actually require additional checks which may delay your application a bit.

Your husband could sponsor you for PR as a spouse, but you would most likely have to withdraw your current application to do so, and then start from scratch with your PR spousal sponsorship which can take up to a year, and maybe a bit more with covid affecting processing times.

I would try to wait a bit more to see if there's movement with your current PR application.

Your GCMS notes would be helpful to know what you should do next.

This will not expedite your PR application.

Your partner cannot add you to his PR. He would need to sponsor you for PR after you are married which will most likely take 1+ years to process. You are most likely much better off waiting for your own PR application to be approved.

If you decide to get married and have him sponsor you for PR, make sure you don't get married on your first trip to meet each other in person. This is a common sign of a marriage of convenience and will cause IRCC to examine your application much more closely for fraud. Visit each other several times in person before getting married.

Now also this begs the question - if I choose to get married before PR result comes through - and inform IRCC about my marriage through a webform - AND THEN my PR application gets rejected for whatever reason (hate to think about this - but it has to be done) AFTER I do this - is this a likely scenario? This would leave me in a very bad situation right?? My PR application is above board with no falsity, but I have to consider this scenario, I guess

The only reason your application would be refused is due to ineligibility. It won't be because of the marriage.

It's really your choice. Have the two of you ever met in person?

Remember that you want to do a few separate trips to see each other before getting married otherwise this looks like marriage fraud.

Let's say that your current PR application is refused for some reason and you have to go for spousal sponsorship. You want to make sure the relationship looks genuine in case this happens. Marrying the first time you visit each other in person is viewed as a huge red flag and typically creates big problems for spousal sponsorship applications. Ultimately it's your choice what you do.

I also have the option to delay the marriage to a later date (whenever convenient).

To avoid the risks, maybe the best option is to just wait for my PR application to be approved as it is first, and only then think about marriage.

Can you confirm if this is the least risky option?
