Hi! I am planning to apply a student visa but i have some issues with the application form. I was married 2012. Since then I didn’t update my marital status. So basically all my papers I am still single. I am not planning to update it because my divorce is now on process. I don’t want to lie with my application so i want to choose separated and not single. My problem is will they require me to update my marital status or i can provide them papers of my divorce? Will it affect my application because all my documents I am single but in the application I will tick separated? I hope someone can help me.
 
If you were married back then, I assumed you already have a marriage certificate, now divorced is in process, you are basically separated.

If every document says single, you can still say single they won't follow you about your marital status unless you indicate you have kids; that's when you can say separated.
 
Yes, I have marriage certificate. So it’s safe to tick Single eventhough I’m still married? Immigration will not dig in? We don’t have kids and he has a partner already.

People have kids all the time without being married, so why should she still tick "separated" based on that?

OP, I'm not sure how you can be legally married for 9 years and still stay legally single? When you say your papers say single, what papers are you referring to? Is your marriage legal? Is it registered in your national database (i.e. if your National Identity number is searched, will it show you as married or single)? If you are currently going through a divorce process now, surely there is official proof that you are married then.

Many people marry and don't change their legal name to their husband's - that doesn't mean they are not married. Is that what you are referring to?

Don't screw up things for yourself. If you do have an official marriage certificate, you better indicate yourself as such in your application. Until your divorce is final (or you have court-issued proof of separation), you are married - regardless of what your other papers say.

1. No, you are married, by claiming single, which CIC will look at as a misrepresentation.

Be very careful about facts. Never tell facts that are not true. If in doubt seek advice of a registered consultant or lawyer.
