I need some help.....I'm from the philippines and is currently cohabiting with a canadian boyfriend for 14mos.....planning to apply for tourist visa and once in canada, apply for common law sponsorship....I have a question regarding what to put in the marital status in the form....single since we're not yet married? Here n the philippines we don't have the status common law...it's either single or married

If I put single in the tourist visa application, would this be a problem once we apply as common law once in canada?

Pls, help :)

If you are applying for tourist visa to Canada then you will put in your relationship according to Canadian rules. So that would be common-law. It doesn't matter what the local rules or customs are in Philippines.

Hi, I have read that it could be a problem, if u write single, and then when you apply Inland PR, they will most certainly back check and wonder why you came as single. And would complicate what you prove as your time being in the relationship and being common law is a long application. Just be honest, there should be other choices besides married or single... At least I remember thailand had more.

Good luck to you!

If you love each other why not get married, because if you are both single and plan to apply as common-law there will be a red flag. The immigration will doubt your relationship...

thank you so much for the advice Rob_TO and Koifish76! :)

as for your question nezya, we can't get married here in the philippines.....he's already married to another filipina and they're separated since 2010....unfortunately, there's no divorce here in the philippines....he decided to live here for at least a year or more in order for us to qualify under common law sponsorship....once we're already in canada, he'll process the divorce and then we could get married... :) i hope i'll get approval for the tourist visa that way we can be together in canada and apply the inland way :)

You don't have to apply through inland if you get a tourist visa to Canada

The processing time is quicker if you apply outland :)

If we apply outland, is it okay if he goes back to canada after submitting the application? And I'll be left here in the philippines while waiting for the decision?

Yes, that's fine. It's a common scenario for the sponsor to return to Canada and the applicant to remain in their home country while the application processes.

It doesn't matter. He can go back at any time or he can stay with you throughout the process. He will need to include proof of his intent to return to Canada in the PR application.
