I am new to this forum and would like to share some thing very important, please read and understand carefully:
The newest op06 provides new details about changes made to the procedure of processing FSW applications received as of June 26 2010.


It starts from page 14, section 7.

- If CIO makes positive eligibility determination then section 7.3 (bottom of page 14) directs officer at CIO to proceed to section 11 to verify meeting minimum FSW requirements

- if verification of minimum requirements as per section 11 is positive then CIO continues to section 12 - assessing the application against selection criteria, pass mark and settlement funds

- then in section 13.1 for apps received on/after June 26 '10 Manual instructs CIO officer to refuse the application if pass mark is not met or, if pass mark is met to forward the file to visa post for final processing.

The above in op06 reveals that it is the CIO that will make the bulk of the processing of cases received as of June 26 2010, including full assessment and preliminary selection decision (refusal or forwarding to visa post for background and inadmissibility checks and final decision)

Please also pay attention to the difference in procedures between cases submitted prior to June 26 2010 assessed in visa posts (section 13.1 at the bottom of page 43) and applications submitted as of June 26 2010 assessed now in CIO (top of page 44).

Applicants who submitted their cases prior to June 26 2010 will be asked for additional information or evidence if processing officer at visa post is unable to make selection decision due to inconclusive or missing information or documentation.

Not so for applications submitted as of June 26 2010. No more second chances here.

As you can see it is the CIO that will do the full assessment of applications received as of 2010-06-26 and make the preliminary selection decision without asking for any additional documents. Application will either be refused or, if assessment is positive, case will be forwarded to proper visa post for final processing.

Again - no second chances. What you submit with original package is the only evidence to be used in the assessment. If it doesn't conclusively prove meeting all selection criteria and pass mark then case will be refused without asking for any additional info or evidence.

It is a major shift from procedural fairness. Everyone should be aware of this.
