Maintaining PR while obtaining greencard

Hello,

I became a pernament resident of canada in 2023 after i came with my mom as refugees and now my father who doesnt live with us obtained a greencard based on employment and is willing to sponsor me since I am under 21 and can be sponsered I want to get my green card because it opens opportunity to work in the us market after I obtain my engineering degree plus i know alot of my friends from university who are dual citizens who get to complete their co-op terms in the US and they get paid way more than people who do their co-op terms in canada so my question is if I get a greencard will canada consider my refugee case abandoned thus loosing my pr status I cannot wait to get my citizenship first because I will become 21 by that time I appreciate any suggestions.

No, Canada will not consider your case abandoned. However you will need to find a way to meet the residency requirements of both Canada and the US. You should apply for Canadian citizenship as soon as you qualify.

I think unlike the canada us doesnt have minimum days to protect ur status its all based on ties I can stay up to a year out of us I believe before i have to apply for a re-entry permit I think I can spend only summers with my dad and work there and comeback and spend the rest of time in canada studying I still should get enough days to qualify for canadian citizenship before the end of the 5yr period

This not really a correct understanding of green card residency requirements. They are actually stricter than Canada. For example, a border officer in the US can revoke your green card on entry if you don't satisfy residency requirements. You have to make the US your primary place of residence to keep your green card. Yes, you can apply for a re-entry permit but can't do that indefinitely (generally 1-2 reentry permits max) and at some point you will need make the US your primary home. It's unlikely that you will be able to get reentry permits to cover five years. However I think it will take a year or two for you to get a green card if your father is just applying now so you may be fine on all of the timing.

I would very strongly recommend you join a US immigration forum and post your questions there to make sure you have a clear understanding of the green card residency requirements. You have a few misconceptions on the rules.

I don’t understand how you’re going to be able to spend over 6 months out of the US every year on your green card. Would also not suggest crossing the border regularly, for example every weekend, on a US green card to try to add to residency requirement. US border agents take green card requirements and people prioritizing making their US status a priority very seriously.

This will work out for the OP if they get a green card in three years (which is likely the case if the father is only applying now). By then they should be very close to applying for Canadian citizenship. And they can apply for a re-entery permit to allow them to remain outside of the US for a couple of years while maintaining green card status.

It would be more difficult if they got a green card now. But they way I read it, the father is jus applying now so the timing should work out well to do both.

Lots of unknowns. Also appears that may only be in 1st yr uni so that could be problematic for 4th yr especially (maybe even 3rd year) if only recently appeared for green card.
