Low income... refusal?

Hi everyone,

I was looking at the denied applications on trackitt and found one that got my attention.

"Application Denied Low income as compared to NOC code"

So I looked my position on this website:

And found that my salary is between the low and the average range

Position is Assistant Manager (Retail, drugstore)

Hourly rate goes is shown as follows:

Low is $11
Average is $18.25
High is $25.59

My rate is $14.42

Does that means that if I apply with that rate, my application will be refused on the basis of "Low income compared to NOC code".

I've been in the position for 7 months only so getting a raise is not very likely.

Any thoughts?

One of the reasons for my LMO denial was low wage. The average was $23 (low $12) and my salary was $16.

My company will now have to readvertise and resubmit the application.

What is FSW2?

That's bad news, I thought I was on the right track and had everything I needed until I found this :(

Most people on Trackitt agree that that post was not legitimate. Members had been debating whether or not salary was a factor in CEC decisions, one person staged that post in the middle of the argument.

To summarize the debate -

- Salary is not one of the factors that CIC uses to determine eligibility for CEC.

- However, salary may be an indicator that someone is "fudging" their skilled work experience if it is far too low for the occupation (e.g. claiming to be an engineer but making 15,000 per year; claiming to be a manager but making minimum wage). This might cause greater scrutiny of your application materials and/or create doubt about your job duties. Not enough by itself to refuse an application, tho.

- And, it is true that salary is an important factor that HRSDC uses in issuing a Labour Market Opinion (LMO). About a year ago, to reduce exploitation of foreign workers by employers, and to prevent the displacement of Canadian workers by foreign workers who accept a lower wage, HRSDC began requiring for LMOs that salaries for temporary foreign workers meet or exceed the average wage for an occupation.

Unless you're faking something, you don't need to worry about it.

I applied for both a LMO/WP (received) and CEC (passport sent) under NOC 1122 and I was making $8 less than average salary. I do not know whether they consider other variables: My current employer gave some strong (and passionate) references (and calls).

Yes, Jes I know :) I'm just sharing my experience that although my wage was under than the NOC average, I didn't have any problems. Thanks

I talked with a CIC customer representative today, he couldn't give me a price answer when I asked him about it. He said I should contact the Visa Office that I will be applying to and ask them so I sent an email to Buffalo earlier today. Once I get a reply all share with all of you.

It's interesting, call centre agents can't answer most of the questions. Actually I think it's furstrating.

Well, I actually contacted Buffalo for a different case (after being referred to them by CIC), and this was their reply:

We regret that we are unable to provide individual counselling nor can we provide assistance in completing your application form.

You should follow the instructions in the application kit. If you are unable to supply any of the documents or information requested, please enclose a detailed letter of explanation when you submit your application.
Looks like nobody knows, or they just don't have the knowledge or resources to answer specific questions.

Buffalo replied today and they say they do not offer pre-assesment services or provide assistance when completing the application form.

So I guess right now we can only rely on our previous experiences or even immigration lawyers.

Anyone hired a lawyer for the application? or even a consultation?
