Hello,

my family and I became permnent reidents in Canada in 2006, our older son joined uiversity in Canada in 2008 and is a regular student till now. I was not able to find work in Canda that pays enoughto cover my expenses, specially with the economic downturn in 2008-2010.I had to work in middle east to earnmy wadges. In July 2011, our PR cards were due to expire and an immigration officer issued a departure form for me, my wif and two yougner children. Officers told us we can apply again but we have to go through the whole immigration process from the beginning.

Is this true...? Will we be able to re-aplly for Permamnent Residence again...?
will our fialure to comply with the 740 days during the first 5 years have an impact on our new applications ?

thanks

You can apply again from scratch. It will not be held against you that you had PR before.

If he is making enough money to support you and your dependents, he can sponsor you for PR but sponsoring parents takes several years to get through.

Leon,

I am in kind of similiar situation losing PR for not being in Canada for 740 Days. My total stay in Canada is 500 Days, Its been a month that My application for renewel is approved and card sent to Immigration office. I am scared of going to immigration office and losing my Status because if they asked for too much proof, I dont have any except DL, 2 years Tax returns, SIN and Health card. No lease on my name coz living with friend, No bills, no Bank Statments etc....I have too much stamps on Passport because I was travelling to US and working there on H1-B
I am still thinking for best way to go and need your suggestion. Otherwise I will be leaving next month. Its better then getting into immigration proceedings.
If I let this card go and reapply after meeting residency requirment than what will happen.
Should I contact Attorney ??
Should I tell them truth ???
Please advise because I am so much worried about this problem and I dont want it to let it go......

Why did you apply to renew before you had the 730 days? You could have just waited and then your PR would have been safe.

Now you have opened up the door for immigration to question your residency. So if they gave you the PR card at all, did you lie on your application about where you lived? If they find out about that, you are in big trouble. When they look at your passport and see all your stamps, it is quite possible that they will withhold the PR card and want to do a residency questionnaire. I do not know what will happen if you don't pick it up. I suppose they will send it back to headquarters after some time and you will have to apply again.

How did you receive the departure form? Did you apply for a renewal of your PR card and then you got a departure form OR did you get the departure form when entering Canada?
