Lost PR card, need to sponsor new born child and keeping Residency requirement ?

Hi all,

1- My wife and kid misplaced their PR card ,and we can't find them. we booked tickets on 15 may, we are PR since 2013 ,my wife and kid now going to Canada for good, but how can we go on board with PR card, we still have the COPR papers,are they enough for travel, or shall I have to contact Canadian embassy to get a TRP, and how long does it take..!!

2- i want to go back uae to because of my other new born kid after we got our PR status in 2013,I want to stay with them till my wife applies for PR for our kids back in UAE,but the problem is i will violate the residency requirement as i cant complete the 730 days , so is there any exceptions where I can still have my PR status which will expire on July 2018.

3- If I exit from Quebec or US-CA borders by land, will the CIC or CBSA register my name and PR number,and maybe they will revok my PR once I return later on after we got the PR for our kid in UAE.

4- how long will it take to get a new PR for an outside of Canada born child for PR parents,especially if they not working in Canada,?

5- is there a minimum fund requirement for sponsoring a new born child outside of Canada for PR parents, I remember when we first applied for PR there was a scale for minimum fund required depending on the total numbers of the familiy, will the same scale be used in our case.

our plan is for my wife and 1 son to stay permenantely in Canada since we been out of canada for 3 years and in this May we will complete the residency requiremet to be out of canada, i can't leave my job at the moment,i need to finance my family and its difficult finding job in Canada becuz of the low oil prices,since i am in the engineering field , I was thinking to come out through the usa- canada borders or through quebec then return to uae,

First of all, will your wife meet the residency requirement once she returns to Canada? Or will she have been outside of Canada for more than three years? This is a very important question to answer since it will determine if she can sponsor your new born without putting her own PR status in jeopardy.

Assuming you have non-visa exempt passports, you need either valid PR cards or travel documents to fly directly to Canada. You cannot fly on your COPRs alone and should apply for Travel Documents immediately (do not apply for TRPs - you don't qualify for TRPs). Alternatively what you could do is fly to the US and then re-enter Canada from the US by land using your COPRs.

There is no minimum income requirement to sponsor a child. Your wife will need to be the one to file the application since she is remaining in Canada (assuming she meets the residency requirement).

Exceptions are sometimes granted for residency requirements - but not for the situation you have described. Working outside of Canada is not an acceptable reason for failing to meet RO.

- well my wife will exactly complete 3 years outside of Canada in 10 of May,so we booked on 8th of may,her PR card will expire on 23 july 2018,so I think she cam meet the 730 days residency requirement provided she dont go out during this time.

- that is not the case with me,as I have to return back to our kid who will stay with relatives till i come for her,and i have to wait till my wife succeeds getting the PR for our child in UAE, but in this case I will not meet the residency requirement myself,i was thinking when i enter canada in may i make exit from us-ca borders or by plane from queube as i heard cbsa wont find a history of travel ,is this right.!!.

- can the cic officer at point of entry deny me entering canada if he/she founds out i wont meet the residency requirement.!!.

Then you better apply for her PR TD immediately. Since she is so close to not meeting RO, there may be delays in getting the PR TD while CIC does their RO investigation.

That is not true, they can find your travel history. Also you shouldn't lie to CBSA if they simply ask about your travel history as that can get you into lots more trouble.

You will still be allowed to enter Canada, but if reported for not meeting RO you will need to appeal and attend a hearing, during which your PR status could be revoked. If this happens, your wife will need to sponsor you for PR again but you may need to leave Canada.
