Hey there. Current situation: My Mexican girlfriend who is on her student visa is 3 months pregnant and we are looking to apply for spousal sponsorship. Her student visa will expire 1 month after the baby is born. We are arranging the marriage very soon and want to continue our great relationship in raising our family in Canada. Is outland sponsorship the way to go in this scenario? And, what can we do about the medical portion of the sponsorship since she is currently pregnant?

Any information is greatly appreciated.

If she applies inland, she can also submit an Open Work Permit app and will be able to stay in Canada for entire duration of processing.

Since she's pregnant, most likely she will want to defer the x-ray portion of the medical (although some people still elect to do it). This means her app would go on hold at some point and wait until baby is born and for her to complete x-ray.

If she applies outland, there is no open work permit and she would need to ensure she keeps her status in Canada valid separate from the PR app. She should probably only pick outland if she really needs to travel outside Canada during the PR processing.
 
In addition to Rob's good advice, I will also chime in that the Mexico VO is one of the slowest outland VOs, so there likely would not be much of a difference in processing time between an outland application or inland application (something that sometimes comes into play when people are trying to decide between the two).
 
Thanks for all the information Rob & KBH! Yes, I've heard that the inland is slower. The fact that the 'inland' does allow an Open Work Permit clearly makes it the best choice for us, as she has worked in Canada as an Architect with a WV prior to her Student Visa. Any experience on how long an 'In-land' application in this situation would take?

IRCC is targeting 12 months for both inland and outland. The more important factor is that with inland app her status in Canada for duration of processing is secured.

Does she have provincial healthcare to cover the pregnancy/delivery?

She does not have provincial healthcare, but is under a student healthcare insurance, that does apparently cover pregnancy costs. Still yet to be determined if we will have any issues with it. If not Healthcare out of pocket will be covered. We want to do everything here in Canada.
 
Just to give you an idea.. my husband just got his PR back in November through Mexico City VO and it took just over 12 months. Mind you we applied in 2016 so in the “old” processing way but it still took the full 12 months, even with a pretty simple application.

Just be aware of the 90 day rule of study permits. If she were to stop taking courses and the school considered this "completing" her studies and reported to IRCC, he valid status in Canada (and any associated healthcare) could end sooner than expected. So make sure you get verification from the school if she will be delaying her studies, not to report that she has dropped out.

She will be and is currently attending school yes. Also, we plan on getting married this weekend, and I just found out we can apply without our 'marriage certificate' but use the signed marriage license, instead of waiting for it. Is this true?

No, not true. If you apply without your actual marriage certificate, you can expect your app to be returned.
