Hi all,

I am new to this forum.I came in canada in 2006 as astudent than i got a Post Grad Workprmit in OCT 2007.then I extended my WP with positive LMO...Now my Workpermit is going to expire in Sep 2009.I applied for LMO ..but it was rejected.my employer just got a letter before 1 day asking for EI and CPP deduction taxes.and the deadline to submit this docs was the very next day.so my employer called to HRDSC and asked for extension for 2 days.but the officer refuse my case and rejected my LMO..now I am going to reapply my LMO.Can you tell me what" EI and CPP deduction taxes" can i submit my paystuff with deducted all things for this requirment..Is it true that at the second time of application, your case will be assesed by a new officer..and will they consider my second application as a "New application"?

I also applied for WP for concurrent processing.will they wait for my new LMO ore reject my WP..

I have put up my file for PR in Sep 2008 and got AOR in march 2009.I am not in 38 list.but i do have 1 year work experience.I want to ask you is..what if i will be rejected for LMO again ..can i stay in cnada untill my PR decision??

and if i have to leave..what abt my PR file..i am from India.so i know my file will be transfered to india..but i cant get 67 points as rules will be different for india..or can they count the condition and rules as per the date of submited application.

whats AEO..as per my knowledge for AEO i dont need to do LMO.can i use AEO to use in my exisiting PR file and stay in canada after expired WP.i also read that about PNP .but for that you must have 2 years experience,i have 20 months exp as of now..but it also take 4 months..i am so confused ...please help me out.

Job Offer........
Pre-Assessed..
If you applied as an FSW under category 3, you do not have to stay in Canada but if you used points for arranged employment, once you are not working anymore, you can not claim those points anymore unless you get an AEO.

If your LMO doesn't come through and your work permit is expired by the time immigration asks for your documents, you can apply for an AEO for the same job to send them instead. It is supposed to be easier to get an AEO than an LMO. An AEO will not allow you to stay or work in Canada. It is just an offer that once you get PR, you will have a job. If you are in that situation and want to stay but can't get an LMO and a new work permit, you can apply to change your status to visitor. There is no guarantee that you will get it but you may be able to stay a bit longer in Canada but without working.

Read about AEO's and LMO's here: http://www.hrsdc.gc.ca/eng/workplaceskills/foreign_workers/supperimm.shtml

The immigration class you are referring to which needs 2 years work experience is not PNP, it's CEC. If you had studied in Canada for 2 years and worked for 1, you also qualify. Worst case, if you end up having to go home and your FSW application is messed up, you can still apply for PR through CEC. If you qualify for CEC, your right to apply stays unchanged for a year after you leave Canada so you would not have to do it right away.
