LMO position requirement vs employer requirement issue

Hi all,

I have a problem that's seen me unemployed for 6 months now waiting for a resolution, and NO response from the CIC.

My employer advertised and received a positive LMO for me, I subsequently received a work permit by applying online. (sounds positive right?)

The problem is that the LMO states an "employer requirement" for a diploma, which i dont have.

The position description advertised, and the NOC which applies to it don't require a diploma, but somehow it turned up on the LMO. I've been doing my job for 10+ years and so satisfied the CIC for both the LMO and work permit, however my employer believes that, while they don't require it, because it's written on the LMO as an "employer requirement" it could make my Work Permit invalid.

surely if its an employer requirement not an NOC requirement, and it was never advertised with the position, it shouldn't be a problem, right? after all, they assessed all my paperwork when i applied for the work permit.

anyhelp would be greatly appreciated!

I'm not exactly sure of what's legal and what isn't, but if CIC approved your permit, I wouldn't worry. If this turns out to be a CIC screw-up, you can always say that you weren't too clear on the rules. You have plausible deniability.
