LMO 6 Months Limit and Re-applying

Hello there,

I have a situation:


A positive LMO was issued over 6 months ago and the foreign workers did not apply for WP in time. In other words the LMO expired. I am aware that a new LMO must be submitted but I do have concerns about being issued a positive LMO again considering it is for the same foreign worker. The ads have been redone.

Do you think this is a problem? do I have to explain why the foreign worker did not apply within the 6 months period?

Yes you will need to explain why they could not obtain thier work permit in the 6 month period.

thanks for the response. I think it needs to be explained as well. But I just got off the phone with Service Canada. The agent told me that I do not need to explain why the foreign worker did not apply in time. She said to simply apply like nothing happened and although the officer will have records, they may contact the employer to seek clarification and employer can simply say 'they didnt apply in time' I hope she is right because it is a hassle trying to explain this issue.

I can see if from the employers standpoint that it must be frustrating. It can also incredibly time consuming for the employee to get all the documentation required to complete the work permit. In particular, having to get previous employers to provide indepth job references can be almost impossible. Hope everything works out in the end.
