Hi everyone,
I don't quite understand this LMIA deal - I was hoping that someone can clarify this for me please.

I have completed a 2-year diploma program. I am currently on PGWP.
I am employed under
2282User support technicians

I will try apply for my PR under the CEC next year.
My question is :

Do I need a LMIA to apply for my PR ? even tough I am currently in Canada and employed ?

Thanks in advance !!

No - you do not need an LMIA to apply for PR and claim points for having a year of work experience in Canada.

However you do need an approved LMIA if you want to claim 50 points for having a job offer in Canada.

Perfect! Thanks for your help. My employer would have to apply for it, correct ?
Also, any idea on when this should be completed or how long the process of getting ones takes ?

You don’t need a LMIA if you have enough points for Express Entry with one year Canadian experience. If you don’t have the points, the employer has to apply and prove no Canadian could be found to do the job. The process can take many months.

it makes sense !! Thanks for clarifying that. I got only 370 points, so I think it might be beneficial for me to try and get one to claim those 50 points.

Yes, you need in the range of 100 more points to have a chance of being selected.

Max out your IELTS score if you haven't done so already.

Yes, your employer is the one who needs to apply for an approved LMIA. This is quite an involved and expensive process for the employer. Plan on processing taking six months.

Yes I will need to look into it. My PGWP expires next year, so I might have to apply for a work visa so I can get more years of employment.

You need an approved LMIA to apply for a closed work permit. So another reason to speak with your employer about this. I would do this sooner rather than later to determine if your employer is willing to support you.

If you mean the LMIA then yes. Your employer will have to apply for that. And currently getting approved of a LMIA is not so easy since a lot of people lost their jobs during this pandemic so it will be very difficult to prove that there is no Canadian citizen or PR could fill that position. Also recently we have seen a series of LMIA rejections for that reason.
