LMIA without advertising?

Hi,

My employer hired me in August 2014 through a rigorous and a very objective hiring process. They wan't to support my LMIA but are not ready to do any advertising efforts again. Can I still apply for LMIA showing the efforts undertaken by my employer in August 2014? What are the chances to get a positive LMIA with that?

I'll be grateful if anyone can help.

I don't think that is possible. You have to convince your employer to make an advertisement, and then your employer should put all the efforts to hire a PR or Canadian Citizen. If he doesn't get any, then only Service Canada will issue +ve LMIA.

That's rude, I know. But that's the process.

Advertising is one of the Major step to get LMIA....As it shows employer is making decent effort to hire Canadian instead of Foreign worker.

Anyone apply for LMIA, Service Canada assessed the application 1 or 2 months later and they will ask you to provide advertising documents again, even though you might send the doc with application already , which everyone has to advertise for 4 weeks, if you are failure to provide that they will refuse.

Its really sad that your employer don't want to advertise. To get a valid LMIA, major part lies in advertising and showing the proof of interview. advertising is the major and crucial step to apply LMIA.. If they don't advertise your position, i don't think its worth even to apply LMIA. I do understand from an employers point of view advertising is a little risky as many will be applying. For LMIA, they need to advertise in Newspapers,websites,magazines,job bank and its good if they apply in couple of more on-line sites.I have started my LMIA process a week ago by preparing job posting. Even my employer denied all this process because they are busy and they don't want to waste time as this is a long process. He arranged me a resource and ask him to pay so that he will take care of advertisement, preparing paper work etc.

How long is the validity of your LMIA? If its still valid, why dont you use the same?

Prashanth85, I am an employer and am in the process of LMIA which is very time consuming while you are trying to run a business apart from the cost and I have heard that very few companies get a positive result. What occupation are you in?

Yes, you are right. Very few companies get positive LMIA. I hired an experience lawyer. Many think that there is no need for lawyer and that too paying very much. But ESDC wont reject your LMIA just like that. They will check each and every point including your job posting and resume. For this we need a lawyer or consultant and this is my opinion because i don't want to take a chance or risk.Firstly the job posting should match your resume and NOC. This is the first and crucial step. If you fail in this then your LMIA will be rejected. Am wit noc 2281 and my work permit expires in July 2015. I do have a very great job with great pay. I am hoping for the best and trust me tensed each and every day.

Thanks for replying!! Which lawyer did you use? There are so many to choose from? You said the resume should match the ad? I have placed three ads with very little response, we are also unionised which makes it more specific. There is no where on the CIC website that is specific to the wording of the ad, I tried to make contact which took me three hours and four transfers and they basically told me to use the website?!?!? I find this process all very frustrating and geared only to lawyers and CIC making money. So disappointed with this whole system. So much for Express Entry :(

I am working with Ravi Jain who works in Green and Spiegel law firm. The CIC website doesn't specify ad but from our end everything should be perfect and rest is fate and luck. I knwo EE is very frustrating
