I need an advice please......
My OH received positive LMIA today!!!!
The problem is that our visa expired a week ago
We sent paper application for a new worker permit for him, open WP for me and visitor for kids. I have a Canada post slip (and online print out that they received applications at Vegreville before our visas expired).
I sent the WP application as per this info from CIC:
"You can only submit your application without a Labour Market Impact Assessment (LMIA) if your work permit expires within 2 weeks. You must include proof that the LMIA request was made.
You must contact our Call Centre with the LMIA confirmation number within 2 months of the date your application was received; otherwise your application could be refused."
If I do this way the waiting time is 95 days. My OH stopped working.
Can we go to the border and get LMIA WP activated? How would they know that we haven't overstayed our visas as passport shows expired visa? The only documents I have is the Canada post proof that the application is received (Should they send me a letter that they received an application?) We were on IEC....
