Hello experts,

I am currently employed on a PGWP with no LMIA. My employer has agreed to obtain LMIA for me. Could someone walk me through what options do I have?

There are two LMIA options, one with the fees and other without fees - which one would apply to me? Please give me your opinion what should be the best course of action for me?

With free LMIA, I can't start working until I am awarded PR? But how does that work, I am currently employed. To do that, do I have to apply for another position for my employer? Please correct me if I am wrong.

You now have PGWP, you don't need LMIA to work.

LMIA for PR purposes is free. and that applies to you.

ESDC has full description of the requirements, procedures and forms for that.

Yes, my manager said they'll do everything to support my application. So what does my employer has to do now? Should I keep working on this position, and my employer has to advertise the same job and after the advertisement posting period they just apply for LMIA (given that they fulfill all the requirements of job add)? Thanks for your help.

Can't find the link to ESDC now.

You can work your current job now, while your employer advertises your job for 4 weeks, show no Canadian have applied or explain why Canadians applicants of your job isn't qualified. Fill out forms and stuff. etc

They are essentially forcing companies to hire similarly-qualified Canadians over foreign nationals, even being more suitable.

It's great that you found an employer who values you so much! I hope they are aware of how tedious the process is though.

To make the process easier for you and your employer, I recommend making a list of everything you need beforehand and letting your employer know instead of getting the info as your go through the form. There is a document checklist in the LMIA application PDF as well, unfortunately I can't post links...

However, I called service Canada and asked if PGWP holder can apply LMIA, he said:

"Technically, LMIA is for a new work permit...so if your work permit is about to expire in the next 3 months, you can definitely apply LMIA"

But I'm in the middle of the valid period of my PGWP... What's your scenario here? I think you might want to call service Canada to make sure you are eligible before you start =)

Just guessing, I think the Service Canada agent is confused with your intention. You are trying to get 600 points for EE while s/he might think you are trying to extend your work permit.

You've answered your own question. To get 600 points, you need a job offer with a LMIA. If you have a job offer and no LMIA, you can still enter the express entry pool but you won't have 600 points.

I'm in the same situation. Have a job offer but no LMIA. Hoping the ITA requirement score comes down to 500 for the next draw. Inshallah.

Thank you very much everyone. Yes, my manager was generous to agree to support me. She sent an email to HR to take care of this process. I think HR should know the process as this is big corporation.

I sent email direct to HR director last Friday. It took me the whole day to draft my email while summarizing the whole EE story according to my situation.
He replied he is gonna see what is required from the company for LMIA and that he would let me know. So far heard nothing back from HR.
Don't know what will happen.

Good luck! My manager said I don't want to get involved in this, I am just too busy. She sent an email to HR saying do whatever it takes to support his application 8) 8) 8) 8)

I have meeting with HR Manager tomorrow. Fingers crossed.

One more question, are there wage restrictions for LMIA? Does the wage has to be at least equal to median wage? I am working on an entry level position, and my wage is little over than the minimum wage of my occupation. Is this going to be a n issue? Thanks
