This week friend of mine had a meeting with somebody that is expert in Immigration processes, somebody that had proved his skills in other immigration topics but not EE.

He have an LMIA to get a new work permit (renew), this work permit application is in process and as far as I know he should have no problem with it.

This person told my friend this LMIA will not be valid to get the 600 points in Express Entry. Looks like she argued that LMIA needs to be different than the ones that are issued for temporal work permits to get 600 points.

I know there are 2 types of LMIAs around there but as far as i know all of them would get 600 points for EE.

Anybody had problems after receive the ITA ? Do you guys knows what she means?

Anyway we can apply for PNP but that means another year at least.

I am pretty sure she is wrong, and she is mixing old programs (CEC) requirements.

I am not an expert, but it sounds like she had it the wrong way round. There is the $1000 LMIA to get a temporary work permit and there is the EE only LMIA for no fee. And there is the dual LMIA for EE that allows the worker to come start employment before PR processed which also costs $1000.

As long as it is for a permanent full time position in skill level OAB. Perhaps she was thinking that the job offer was only a temporary one, in which case it wouldn't qualify for EE. Again I am not an expert, but that's how I understand it. What is the wording in the job offer?

What I understand reading the below page is when employer files new LMIA, the employer needs to select the option whether LMIA is supported for TFW, PR or dual.

But if the candidate is already working in Canada with +ve LMIA, new LMIA isn't needed(basically old LMIA/LMO).

Yes. As long as the TFW is in Canada working under a positive Labour Market Impact Assessment (LMIA), you can offer them a permanent job to support their application for permanent residence. Your TFW would have to create an Express Entry profile and include their job offer information. A job offer supported by an LMIA will give a candidate enough additional points and be ranked high enough to be invited to apply at the next eligible round of invitations.

If you are considering permanently hiring a TFW and you do not have a positive LMIA for the job, you will first need to make every effort to try and find a Canadian or permanent resident to fill the job opportunity. You will need to meet LMIA requirements, including posting your job ad on Employment and Social Development Canada's (ESDC) Job Bank in addition to advertising in two other places. If you have done this and have been unsuccessful in filling your job opportunity, you can apply for an LMIA for the TFW through Service Canada. The TFW would then have to create an Express Entry profile, meet the minimum criteria and include their job offer information so they get enough additional points and be ranked high enough to be invited to apply at the next eligible round of invitations.

Ok so here is the rub.....it states a positive LMIA, so that would have to be newly acquired. An LMO did not have such stringent requirements. Am I interpreting it correctly?

It says TFW not EE unfortunately. Looks like employer didn't select PR. The job offer must be full time and permanent.

As my opinion yes 600 will get, why you not go ahead create profile and enter information. You will get the answer.

I got LMIA for TFW last yr. Using the same LMIA I applied for Express Entry and I got the invite.
