Hello everyone,

I really need help on this one. I am currently in the EE pool with 457 points and my WP is expiring on 8 Nov 2016. My employer is ready to help me for an LMIA on my current job.
My questions are:
1. Can my employer file for an LMIA for the job which I am currently working?
2. I have heard that LMIA for Express entry (just to get 600 points) is bit easy than getting LMIA with a closed WP. Is it true?
3. What would be the processing time of my application once it has been submitted? Is it 2-3 weeks (one of the consultant told me)? (My employer has already put up the ad on job sites according to guidelines)
4. Will my employer need to pay $1000 processing fee?

Anyone who has idea regarding this please respond.

1. Yes, it should be of the job that your employer has hired you for. You should also have completed at least 1 year of this job (can be from past employer)
2. LMIA for EE? If an employer will provide you LMIA then that is given as closed WP. You cannot use the LMIA w/ another employer, and will not be given an open work permit using the LMIA.
3. It depends on what your job is. Fastest are for skilled worker jobs which I heard is 10 business days if there is a ready LMIA/ unnamed one.
4. Yes, your employer will pay $1000 LMIA fee.

I have already have 1 year experience since April 2016 (with same employer) and I still have about 5 months left on my WP, would I still need to pay $1000 fees? since the LMIA form asks whether you are filing for permanent residency (without paying fees) or for permanent residency/ work permit (paying $1000 fees). I really wont require WP based on LMIA till 8 Nov 2016.

1. Yes. It can be for your current job. In the document form to file there is an option to say "the employee is already working...".
2. Depends. there are 2 type of LMIA. For a WP, or to support PR. Second option allow to ease-up on the "transition plan" requirement. Sponsoring for PR is the only activity required. So it is indeed easier.
3. LMIA for PR are also processed quicker. It should take about 10 days.
4. A LMIA for PR is free. Unless you ask for dual-intent LMIA, which means you also require a WP.

If your employer is OK with the fees, it's easier to ask for the dual intent. Less stress on the entire process.
But you do have the option of asking a BOWP later once you apply for PR. November is far enough to give you the time to apply for PR.
