Living vs. Visiting American Spouse -Please Help!!

Hi all,

I'm new here and I was hoping someone could help me clear my confusion.

My husband is American and he has been visiting with me for six months since our marriage in October (six months coming up in April). We have already applied to extend his status as a visitor so he can stay with me while we apply for his permanent residence and waiting for the results of that. He is now here on implied status as of April 2017. We are now in the process of getting the Sponsorship & PR application ready.. but I'm concerned that If I tick of box #3 of the checklist (apply outland while "living" in Canada) it will contradict the rest of the application.

What I mean is he has only been here for 5.5 months and i'm not sure that it classifies as "living" therefore on forms like "Relationship Information and Sponsorship Evaluation (IMM 5532 E)" where it asks "Are you living together now?" I have checked off "no" and explained why and that he is currently visiting me and we applied for extension.

Another thing is if I were to check the box that he is currently living here while applying outland, then further down on the checklist it asks to provide two different documents to prove that we currently living together. I do not have any joint utilities or leases because he is staying with me at my family house during the visit.

So my ending question is, given my circumstance, would choosing option #3 contradict the rest of my application? Please help me figure out what to do as I have called CIC several times and the lines are so busy they tell me to try again later.

Hi

You should be selecting "Yes" for living together. It doesn't matter that he is here as a visitor. He is living here and you guys live together.

If you don't have the proofs, you need to include what you do have showing you both reside there and a letter of explanation.

Option 3 is the correct selection.

A bit off topic but I think that requirement is pretty silly since many people have temporary living arrangements or "unofficial" arrangements.

Do you pay any rent? You could just get the owner of the house to write you a sort of rental agreement if you pay rent, or just a letter from them explaining the living situation.

In your letter, just explain why you don't have an official rental agreement or lease, or utility bills. Though you could add him to a phone plan or something as well.

I will have a hard time showing these documents because we are living at my husbands parents house at the moment, and we don't have a joint phone plan yet because we want to wait until I am a PR.

Thanks so much for the reply! Okay so I can definitely get a rental agreement but my phone company won't allow me to add him on and all of the utilities are under someone else... Do you think the rental agreement and a letter of explanation about why i dont have the utility or government issued identigication would suffice? Maybe I can include two more things from the next next list (joint bank account and him as a beneficiary on my insurance)? Would that work even if they specifically asked for 2 of the first three if he's living here?

Since you have the rental agreement satisfied, then yes you can provide other documentation for that part of the checklist, and then one more category from the second part (like a letter from family).

Thank you so much Aquakitty. So I will provide the rental agreement, a letter of explanation and then two more from the next list. Do you think I should provide the 20 photos and 10 pages of communication etc... since im lacking in evidence to prove that we are living together?
